Consequence of Swirl Flap Delete

I have a 55 plate ML320 with 91000 miles. The trader I bought it off had the swirl flap file deleted because it otherwise meant two new inlet manifolds and all the stuff that goes with it. Expensive. What are the consequences of not having the swirl flaps installed. On kickdown I get a big plume of black smoke. Could this be as a result of no swirl flaps or something else?
 
How will it fare with the new MOT firstly....?
 
Well the MOT will run the engine above 2000 revs so the flaps would be wide open anyway,so I would suggest you give your engine a good clear out,run the fuel down to sat a quarter of a tank and put in a good slug of engine cleaner in say a industrial site early morning and then drive on low gears with plenty of revs that will clear the engine out,fill up with fuel,make sure you take the car to the MOT station and rev the car to 3000 revs just before they do the MOT this will heat the exhaust gases and you should get through the emissions.
