Does anyone know what the "date of liabilty" refers to as on DVLA vehicle enquiry??

Date of Liability 22 11 2005 Date of First Registration 01 03 1997 Year of Manufacture 1996 Cylinder Capacity (cc) 2295CC CO2 Emissions Not Available Fuel Type Petrol Export Marker Not Applicable Vehicle Status Unlicensed Vehicle Colour BLACK Vehicle Type Approval The information contained on this page is correct at the time of enquiry. Vehicle Excise Duty Rate for vehicle 6 Months Rate £96.25 12 Months Rate £175.00

**Just looked it up and refers to licence/tax however surely being a dealership the car mentioned above must have it sorn or by using trade plates, surely if I went to tax it I would not be liable to pay since 2005!!!!!!!**

I assume this is when the previous owner applied for SORN. Perhaps to claim back the road tax? I dont think the vehicle can be used on the highway even with trade plates so the vehicle hasn't moved much since that date. Remember that no licence may mean no current MOT!

Thanks, I'm sure it'll be fine, and since 2005 that IF the car hadn't been licenced or SORN then the dvla would have been in contact with whoever in respect of tax.

The car now has an MOT as of today!!!!

Gina, I know you're not gonna appreciate this (as it's going to cost you £50) but I would strongly recommend that, when you pick the car up, you take it to an MOT station in your area and get a new one done.
I know a lot of car salesmen who have either MOT facilities on site, or use a 'friendly' garage.
I had this when I bought a Vauxhall Omega Elite 3ltr 8 yrs ago. I got stopped about 4 hrs after I bought it (I was being silly:devil: ) and they found the bottom balljoints to be hanging off:crazy:
£50 for peace of mind;)
Just my £1.27p's worth.

No problem, I know what you're saying. By the way, I can get an MOT for £20 down here!

Plus make sure you tax it for the whole of this month   The DVLA will not hesitate in claiming back any excise duty.

I accept you will fill out all the correct documents stating you bought the car on whatever date you purchased it, but the vehicle has now been used on the highway? (Unless it was MOT'd at the location it was put off the road)

Good luck with the car,
John

John

My understanding is that Gina becomes the owner of the car on Thursday - ie the 1st of the month. It will only need taxing from that date as it is acceptable to drive an untaxed car too and from an MOT testing centre for the purpose of putting it through the MOT;) So the car does not need to be taxed for this month ;)

Yes, I am not the "owner" until I pay the rest of the money for the car, hence why I opted for the 1st March, I did not want to waste a months tax for the sake of having the car 2 or 3 days earlier!

Would he, the dealer, not be able to use his trade plates for the journey to/from MOT centre?

Hi girls,
:) :) I would be very careful about this. With the new computer based MOT and taxation, it might flag that the vehicle has an MOT dated in February, but a sworn certificate stating it has been off the road since 2005!

I always say if you do not know the correct answer to a question, then DO NOT WAFFLE :o :o I DO NOT KNOW the correct answer, I have noted that one very knowledgeable member states they think trade plates cannot be used? If I were Gina I would make sure that everything, especially the change of registered keeper is dated the 1st of March. We are NOT talking about one months revenue, if the keeper has signed a document stating the vehicle has been off the road since 2005 then that is when the DVLA will want to claim it back from.

If I were selling you the car, then I would make sure I dated the documentation prior to the MOT date.

Good luck,
John the stirrer

But to put it back on the road the first thing is get the MOT. Everything else then falls from the MOT being in place. The car can't be licensed without the MoT.

DVLA website - SORN section said:
When can an untaxed vehicle be used on a public road?

An untaxed vehicle cannot be used or kept on a public road.
There is one exception:
You can drive an untaxed vehicle on a public road to and from a pre-arranged:
  • MOT testing station
  • VIC testing station
  • an approved vehicle weight testing station which covers design weight certificate or plated revenue weight
  • reduced pollution test
  • provided that adequate insurance cover for your use of that vehicle is in place

Hi Pammy,
That is exactly why I have suggested it be taxed from the beginning of this month.

The vehicle has been driven on a public road during the month of February, it doesn't matter if it was February 1st, or February 28th. When you tax a car, if there is a break between the expired tax, and the new one, then someone has to swear it has not been driven on the public highway?

John the man of many faces :D (I hope I spelt that right  )

Taken from a government website:

What are trade plates for?
People use trade plates for different purposes and reasons, depending on their occupation and business.

If you're legally entitled to use a trade plate, you can put a trade plate on a vehicle and drive it - even if the vehicle hasn't been registered with both plates and a current licence, and in some limited situations, if it has no mot.

Yeah - but the point is it can be driven untaxed on the public highway as long as it is too and from the MOT station only. To then tax it on Thursday will be fine. As long as the car doesn't go on the road again before then.;)

:) :)
I finally see where your coming from and hopefully Grav has thrown further light on the trade plates issue.

On the SORN form is there a mileage section?

Regards,
John

One thing everyone has missed.
The vehicle is showing up as unlicenced, not SORN.

The following is taken from the dvla website:
SORN declarations are valid for 12 months and must be renewed, if the vehicle is kept off the road for a further period.

Therefore, the registered keeper is liable to a fine from the date of liability.
There is nothing to say it was ever declared sorn.

Edited to add: Gina has nothing to worry about as long as she makes sure the date of purchase is correct as John said.

Now, this is a good discussion:rock: :bannana:
