Before christmas I was involved in an accident and I honestly believe that the other party are at fault. A brief outline is that I was traveling on a country lane approaching a blind left hand bend, the other car came round bend at some speed. Much faster than I believe the road was suitable for, anyway I managed to bring my car to a stop close to the near side. The other driver faled to stop and hit my front offside. The other cars air bags deployed but mine didn't, am I correct that airbags will only deploy if a vehical is in motion. I am hoping that some one on this forum knows the the workings of the airbag electronics

It's down to relative motion, or in fact aceleration to be precise.

You can have a parked stationary car, if a van drives in to the front of the parked car then the car's front airbags bags are likely to deploy.

Equally you can have a parked van, if a car drives in to the front of the parked van then the car's front airbags bags are likely to deploy.

Sadly for you, if you're trying to prove you were stationary and he was moving then this is not possible by the evidence of the airbags firing or not.
 
If you were pushed back on impact and the brakes were on, you would have marks on the road or grass going back, ie from where you were stopped to where you ended up with glass etc at point of impact, did you get any pictures.

No makings left on road was a less than 30mph impact, The driver wasn't even looking my way he was talking to his passenger, his passenger spotted me before the driver. It was a wierd experience

In my experience, and I have had quite a few low speed accidents, if there are no independent witnesses or quite clear photographic evidence, the insurance companies will, more than likely, go for knock for knock.

This is a real pain as it may well effect you insurance history and no-claims.

I once "banana-ed" a golf at a set of lights, my air bag did not deploy, so when the other side accused me of driving too fast, my airbag not deploying helped, but, not as much as the three witnesses. My C180, minor front end damage.

I always carry a disposable flash camera and photograph the driver!

Yes disposable cameras with film are the way to go. Digital photo's can be tampered with and are not admissible as evidence (i believe).
 
The description of your sorry tale is IDENTICAL - and I mean absolutely IDENTICAL to what happened to me about 7 years ago.
The bottom line was - as there were no independant witnesses, it ended up knock-for-knock.
Despite all my many protestings.

Digital Images are treated no differently to Developed wet film photographs when used as evidence in motoring cases as long as no serious injury or loss of life are involved and are admissible.

In a serious criminal case if digital images were to be admissible the magistrate or judge would ask that the images submitted have been verified as unaltered and original. This would involve such things as checking the original image file electronic data, and even image analysis from a recognised lab who would certify them as original

don't forget most speed camera images used for prosecution are digital !

Well it does look like its gunna end up 50/50 but it won't happen again. I have just invested in a dash mounted camera/recorder. As I do a lot of journeys down country lanes it will have a double use 1) help in accident situations 2) sell the footage of nutters on the road to reallity tv shows :p
i will post on here how good it is after evaluation

Would be interested in the dash mounted camera recorder if you want to share the details, I have a couple of heavy duty windscreen mounts for small cameras that we use on driver training, one pointed at the driver and one pointing at the road, does the one you have come all in one unit? Been looking for something similar for a while but never really found anything.
