Insurance invalid if caught smoking?

Well to me it seems fair......sorry

The adage for insurance is

"To pay a premium commensurate to the risk the insured brings to a common pool of risk"

If the smoker brings a higher risk to the pool then his premium should be higher OR he ought to be insured within a common pool of smokers only.

I don't see how listening to music and smoking whereby a lighted instrument is in your mouth on being held can be compared.

If this continues, It will soon be illegal to talk while driving.
 
The article does say though that it is prosecutions for driving without due care and attention which gives 3 penalty points.

I suspect that most insurance companies would and have already given drivers, who have earned a penalty for driving without due care and attention, a hard time.

So nothing new there then!

What is new is the Highway Codes definition and subsequently the police action.

How about when the drivers internal organs are being shattered along with other peoples ears in the vicinity

But one could say - what if I'm not talking on a mobile just listening.....

Bottom line is its illegal.

As for smoking - has it actually been made illegal? But if one thinks about it in all seriousness - you are driving with a lighted device in your hand - if a tip drops off into your lap what is your first reaction? Perhaps smoking could be deemed more dangerous than using a hand held phone whilst driving.

I can see why this makes people feel that their personal libities are being infringed - but what about the poor people that get hit whilst the driver scrambles to get the hot tip out of their laps...

I suppose I am just in the minority here as I feel strongly that smoking whilst driving is dangerous and should be banned. Oh well at least we can voice our differences here with decorum and good grace.:bannana:
 
I am a smoker and I have myself made it a point never to smoke in the car and have held that for the past 4 yrs even if stuck on m25 for 4-5 hrs.

Not because of saftey reason but just to avoid the car smelling like an ashtray when any non smoker gets in.

How do you come to this conclusion?
Because it seems to be one new law after another. So why now, and not 20 years ago ? Is there a logical answer to that ?

Over the last few years, between speed cameras, Vosa vans, surveilance cameras, MIDAS, child booster seats, number plate size restrictions, road tax penalties for larger engines, emmision controls... Have I missed anything ? Why not make it law to wear full head crash helmets and flame resistant overalls for all drivers and passengers. May sound silly, but not so silly if your involved in a bad accident and the car bursts into flames.

Don't see any laws emerging for emmision controls for Boeing or Airbus jets, which are the biggest poluters.

Makes you wonder if there is a "think dept" sitting there to see what they can come up with next, to hit the motorist.

One thing that I am not sure about, is it illegal for a truck driver to talk into a mike on a CB while driving yet ?
 
there is nothing more than a baby or a child in a car that requires more CARE or ATTENTION while driving ...just because there clamped in to a car seat does not stop them demanding through the various methods at there disposal that have been proven through time immemorial to stress a mother or father out ...and thus draw the ATTENTION away from the driving while CARING for the urchins needs. be it the throw over the shoulder here's your bottle ..... the twist and slam dunk a biscuit into there waving arms ...or the turn around eye contact "if you don't stop hitting each other" crash bang wallop .....

so smoke i will with due care and attention .......

As a smoker and addict, I'm probably far better behind the wheel with a cigarette than without. :)

Lets not forget the highway code isnt the letter of the law.
