Just had a knock, advice please

Anything with a 3 Pointed Star!
Drivng along a B road, then turning right onto a residential road. As I turned right, the car coming out of the road and turning right hit my rear bumper.

Here is a photo I took before moving the car, it shows that he was still moving forward after hitting me:

This show how far he had come out before he stopped, i took this after i parked up. You can also see the road layout:

He has not yet admited liability, how should I proceed? The cost of the repair is probably going to be less than my excess.

Contact his insurance company. The liability definately lies with him so they will normally want to settle as cheaply as possible.

If they pay for the repair directly the cost is less as there is no admin cost.
 
Sorry about the bump - any chance you could make the pics smaller though - they are huge and so it's not easy to see what's what ;)

Don't know? It's easy to see what size chips were used in the tarmac..

I would think that him coming onto the main road would mean he has to yield to drivers on the main road (i.e., you). Also, he is so far beyond the footpath/road level he basically wasn't paying attention at all. The photos make it clear that you had right of way.
 
Thanks for making them smaller - much easier to see what's what.

He was certainly a tad previous in pulling out!
 
Don't worry about the other driver not admitting liability, I think you will find on all driving policies that it stipulates you must not admit liability.

The ideal situation would be for you to have a completely independent witness, but failing that a statement from the other driver saying they pulled out from a minor road and collided with your vehicle which was on the major carriageway?

Don't forget if you want to keep up the Mobilo cover then you will need any repair carried out by an approved agent or Mercedes-Benz main dealer.

I concur with Dieselman regarding having a chat with the other drivers insurance company.

So sorry to hear that, hope everthing gets sorted. You have taken pictures from the incident and its pretty clear you where in the right. How much damage is there to be exact ?
 
Thanks for the advice guys. It just really annoying, your going about minding your own and someone not paying attention can ruin your day. Still it could have been alot worse.
 
I was looking forward to seeing a piccie of your 124 mate, though thankfully it wasn't the damaged car eh... :p . You definately had the right of way, and he looks like he's payed no attention whilst pulling out...what a plank.
 
Playing devils advocate for the "opposition" here.:devil: :devil: Just "suppose" he was to say that you were not on the crown of the road and had failed to indicate you were turning right.:eek: He assumed you were going straight on and pulled out? I think he is probably still in the wrong but perhaps that would muddy the waters somewhat and make it more difficult for the insurance companies to apportion blame. :confused: Please don't think I am disputing your version of events, I'm just trying look at it from a different perspective. Sorry to hear of your ding. Its so annoying when these things happen.:(

"You should not pull out unless it is safe to do so." It says that in the highway code :)
