My C55 Estate got whacked

If you are overtaking and someone enters the road from a side road or drive way on the offside...they are in the wrong should you bang into each other...because it's not about whose side of the road it is... but about lack of due care and attention. So, whether this numpty had been driving out forwards or backwards...he's in the wrong..."mate".

I do sympathise with the OP.
Today I arrived home to find SWMBO had managed to crease the rear passenger door on the underground parking entrance gate. **sigh**. Still its only money and luckily this time it will be her money paying for the repair. Fair's fair! Hope it all gets sorted.

Yup I got that. I think it's just a reaction to automatically not accept blame.

Possibly he realised the game was up and wanted a punt.
 
Checked with friend last night who is in the Traffic Police. He immediately said that reversing into a main road is a NO NO!

From a side-road, yes. From a driveway, no.

Your friend in Traffic needs a refresher ...... :)

However, all drivers should proceed with due caution and consideration for all other road users.

Since you were on the main carriageway and he was entering this from a driveway, the onus is on him to ensure that his manoeuvre was carried out safely.

His fault.

My Traffic friend was stating what you said. I.e. the onus is on the person reversing into traffic to check. He obviously did not do that.

The insurance tell me it should not be contested purely by the fact he reversed out his drive over a pavement and hit me on the rear quarter which shows I was behind him when he left his drive.
 
Picking up daughter from school yesterday in my C55 Estate. A van parked on my left. As I go around him (empty road ahead) I catch a glimpse of movement in my overtaking mirror. It's a Ford Fiesta reversing quickly out of a driveway on my side. Crunch!! Reversed straight into me, hitting me just under the petrol flap and pushing me further out into the road.

I stop. He drives straight back into his driveway, gets out and states "you were on my side of the road mate". He has little or no visible damage. Unfortunately the same cannot be said for my car. Rear wing is pushed in over the wheel and he also managed to make contact with the wheel.

Nobody hurt, which was/is the most important thing.

He continued to state that it "was my fault" as I "was on HIS side of the road". No argument from me. I just asked for details gave him mine and told him I would claim and he should leave the blame to his insurance.

My insurance have immediately said there is no argument about blame. The third party is to blame:

1) He reversed onto a main road.
2) He has obviously NOT seen the length of my car passing in his mirrors as he hit the rear quarter.
3) There is no such thing as "My side of the road" I was completing a valid overtake.
4) Had he reversed into the front of me? Still no argument as point (1) trumps them all.

I now await the insurance to take the car away for repair.

So why do I feel bad? He actually was a nice chap and he had his kids in the car. Who whilst a bit shaken were all OK.

I have never heard that it is an offense to reverse onto a main road (until yesterday) can anybody confirm.

I can confirm that as I did exactly what the fiesta driver did about 22 years ago and was informed by the police at the time that is was an offence.
 
I always find it amazing how many people I see on the phone driving a newish prestige car that I know has Bluetooth handsfree.

Why do they do this?

Yes Lee you're right. I've seen loonys in new 911s, Audi R8(my business partner who got caught rightly so) and countless more. Total ar5e behaviour.
 
Well today things took on a different perspective. I am unsure how this will affect me, if at all?

My insurers called me to say that the registration of the car that hit me is not showing on the National Insurance Database.

My insurer is adamant that "I do not need to report this to the Police". They did say that it is possible:
1) The database is incorrect.
2) The driver has cancelled his policy since the accident.
3) He has no insurance.

They have his address and confirm that it his address and the car shows up on various car check sites as the correct car.

The car is still parked in his drive (I see it every day)

Should I inform the police? or should I do as my insurer says and leave it all to them.

I don't want to get to weeks down the line and then be told you should have told the police?

Yes he gave me his insurance and also went into his house emerging with what looked like insurance docs.

Yes they have written both to him and his Insurers (the ones that I gave them) but my insurer says that the policy number he gave me is not a valid policy number (too many digits)

I am insured but don't wish to end up out of pocket. I am already looking at a £500 excess.

This may all be a storm in a tea cup. I thought best to ask if others had any advice.
 
You don't have to pay the £500 excess because the other party is at fault.

I wouldn't inform the rozzers until you know for certain that he's not insured, when I put vehicles on my traders insurance it can sometimes take a while for them to appear on MID.

That really sucks.

It seems you really are a nice guy, seeing the positive side of things even after he jumped on you saying it was your fault.

I think hearing him ranting about how it was my fault would have made me see red!

I hope you get things sorted out quickly and painlessly.

My worry is this. If he is not insured then I suspect that he will simply state he never had the accident.

My insurer says I do have to pay the excess to the repairer and they will attempt to recover that from the third party.

I can this this costing me big bucks.

If he has scuffs on the back of his car with your colour paint, I would be tempted to take some pics. I did the same when a local taxi hit my parked car outside my house - they tried to hide it from the police but I found it and took pics - they didn't contest after that (although I did get an ar$ey phone call saying they would say it was my fault.... for parking outside my house!

I did exactly that this afternoon. The car is still sat in the open on his driveway with it's bumper and tailgate bashed up.

Sent off to my insurers pointing out that he is still facing front in which means he still has to reverse out.
