My C55 Estate got whacked

That's appalling. You need a Miss Marple to grab the local inspector by the ear and tell him to do his duty....

Does he own his house or renting? If he owns it - use your legal protection to issue a claim against him. Then if he refuses to pay the bailiffs will move in to recover debt.
I would now be writing a letter to the police commissioner and cc in the Chief constable outlining the attitude and lack of interest of pursuing an uninsured driver unless TV cameras are present.

Well he still drives the car daily. Taking his kids too & from school. I have to sit there and look at his as he drives past, uninsured with a car full of kids twice a day.

So next time you here some tale of woe about uninsured drivers and the law don't even bother thanking about reporting it.
 
Just how angry and thirsting to put some rain in his life are you?

Are they all his kids? Even if so, have you thought of getting on to your local Social Services and complaining that he is putting children at risk?

I would also try your local Police Commissioner, cc the Chief Constable, regarding the clear failure to enforce the law (as already suggested).

Don't be silly. Social Services won't do any such thing, but it might put some rain in his life, which would be the object of the exercise. It would be if I was the aggrieved party...
 
Around 15 years ago... I was driving an old company car (Ford Escort estate used as a van), and stopped at the side of the road to make a call on my mobile.

The rear of the my was partially blocking a drive. Next I hear an engine roar and a car reverses out of the drive and hits my tail light.

I saw it coming, but I was parked with the engine switched-off so did not have enough time to move out of harm's way.

Out of the reversing car came a very irate woman who shouted at me that it was my fault because I was blocking her drive.

I really didn't care much about the smashed tail light on the estate/van. Her car had no damage as she hit the plastic lens with her bumper. Her drive was sloping downwards toward the house which meant the rear of her car was pointing high up in the air.

But I did suggest that if a child was walking on the pavement she would have knocked him down. She insisted she would have seen the child... even though she clearly did not see my car...

At this point she demanded I move my car as she was late for school - it was just after 9am and there was a child in the rear seat.

Luckily for me the damage wasn't 2k... I bought the plastic lens at a local motor factor for a tenner and replaced it myself.

Hope it all works out for you and the other guy coughs-up.
 
It does not matter whether he drives the car or not , nor does it matter whether the car is on the road or on private property . The Continuous Insurance Enforcement legislation ( CIE ) which came in recently requires that any car which is not declared SORN must be insured .

It isn't a matter of the police needing to catch him in the act , if the car is taxed but not insured the offence is complete .

I would be tempted to do a vehicle enquiry on the DVLA website to verify whether the car is taxed or SORN . If it is not SORN then I would be minded to go down to the local police station and make a formal complaint about the lack of action .

The local press may also be interested in the story - it is surprising how many official bodies can be prompted to take action in the light of a bit of publicity .

I had a look on the DVLA site. The registration shows as "unlicensed"
 
Sorry to read about this blood boiling dilemma. The problem with reporting anything about this matter is that it is uncorroborated. As you see him driving most days, can you not film him and offer video evidence, with the day's paper as a continual, uninterrupted video reference? I would write, as others have suggested, to a higher authority in the police, as well as others mentioned.

A point about excess payable mentioned earlier. You would still have to pay it yourself and claim that back from the third party, unless, of course, the third party insurers arranged for your repairs to be carried out in the first place.
 
Okay, you have a local hobby-bobby or PCSO right?
You will have, ask the local nick for the mobile number if you don't see them about.

Explain what you see, and that it's an easy hit you just need a witness for the school run.

They will be all over it like a rash - trust me.
Whilst they don't normally have direct powers over traffic, getting one to corroborate what you see daily will get a result.

Thought about some photos? I would wait at the bottom of the drive and snap away.
If nothing else it may make them think. Then send it all to the local rag...

After many more calls to the Police they eventually agreed to "look into the matter" o condition that I call in at my local station in person and produce my documents.

Now call me old fashioned but I am the one making the complaint.

Now at my wits end I drove to the local Police station and presented my documents which were logged against my original crime reference number. I was told "your documents are all in order" This is good news as I may never have known this.

The Police now say that they will look into the guy driving his kids too and from school in his uninsured, not taxed or MOT'd car.

I left the Police station to be greeted by a parking warden slapping a £70 fixed penalty notice on my car as I was two minutes over my ticket time.

I considered attempting to eat my own head or possibly scream out to God to ask what I had done to deserve this. Killing the warden was also in my thoughts. Instead I opted to appeal to his better nature. Wrong move.. He didn't have a better nature or indeed any nature. "Ticket is issued. It can't be unissued." Then in a moment of supreme irony (lost on the warden) he uttered the words that made my day. "The law is the law sir. We have to treat everybody the same"

Presumably that statement does not apply to the guy who crashed into me.

Armed with my £70 FPN I can now see the logic in having no tax, insurance or MOT. It's cheaper. The Police leave you alone. If you have a crash it doesn't cost you anything.

Muggins like me thought that all the legal stuff was there to help.

If your overstay really is 2 minutes, then you should appeal as I understood they are meant to give 5 minutes grace.

Appeal submitted this morning. I now await a fine for making a spelling mistake in my appeal. I am frantically searching my memory bank for ill deeds committed in a past life (or indeed this life).


Oh. In case anybody is worried. No I haven't had my car repaired yet. So I am driving about in a car that looks like it came last in the Wacky Races.

Another tactic which might prove useful would be to wait until he leaves on his daily illegal excursion and then park another vehicle across his drive , thus preventing him getting his illegal car back onto it . ( Ideally , get a friend who may be a parent at the adjacent school to do this if possible ) then have a third party call the police to report the altercation which will undoubtedly ensue on his return - if the police actually do attend then the offences relating to his car may well come to light , especially if you just happen to be passing , having dropped off/collected your own kids from school ( hence why the blocking should ideally be done by someone else ) and able to remark something along the lines of " I say , officer , this is the car that struck mine recently and I have reason to believe it is uninsured/unlicenced ,possibly not MOTd , I wonder if the driver has a valid licence ???"

Do you have any friends who might do that small favour for you ?

Well here is the latest.. Prepare to be underwhelmed.

First some good news. The Parking ticket/fine was cancelled after I wrote explaining the circumstances. Common sense prevailed.

Feeling bouyed up with new sense of belief in the system I called my insurers to enquire on progress. This was a bad mistake.......

My insurer "Morethan" is still waiting on the third party to reply to their letter. I again pointed out that this may be a long wait. They agreed but said they "have to follow process". That process means that they write three times. If they get no response they will then decide how to proceed. I cannot take any legal action through my insurance until this process completes. Insurance then asked why I was not chasing the Police for a criminal conviction?


I called the Police again. This is the fourth call and second visit with no action.

The Police now say that they need my Insurer to complain to them about the accident before they will investigate. They suggest that I call my insurers and tell them to complain to the Police so that the Police can investigate my complaint that they guy is not insured. The Police agree that he is not insured and that he has no Tax & no MOT along with no Insurance. But me telling them that is not reason for them to investigate as I am not an insurance company.

So the the moral of the story is this. Do not bother having insurance. It will cost you more money if you get hit by somebody who is not insured.

Never ever expect that the Police will act on information received or provided by you.

Oh. I am not making this up. SO if anybody on here works for Morethan and wants to give a PM lease do. I am now stuffed.
