Police Clamping Car

The local police have Clamped an old MG which is parked on the Grass verge near me, outside someones house.

The Notice says "ROAD TAX OUT OF DATE."

Question - As it isn't parked on the road are they right in doing this?

The only reason I can see this being right is if the House Owner has reported it parked illegally. The guy opposite me repairs old MGs and always has one on his drive without Road Tax or MOT. This one is not his though.
 
Parking your car on your drive will not require it to be taxed.
(although it does require SORN)
Parking on the road, a pavement of a verge requires a tax disc.

Depends on who own's the aforementioned verge.

If it's public highway then it must be taxed. If it's privately owned then it's on private land, and therefore not on the public highway.

The front garden of my last house appeared to go down to the road. In reality the final few feet were actually footpath and therefore part of the highway, and was shown as such on the deeds. It wasn't obvious though as it was just turfed, not a hard pavement.
 
I once had an old Suzuuki SJ14 that I'd parked up without road tax on the road outside my house as it wasn't beeing driven at the time. Because the road is private, it didnt actually need to be taxed. The council however stuck a note on the car which read something along the lines of.


"The Borough of Richmond upon Thames deem this vehicle to be in such a state of disrepair that it ought to be destroyed. "

Cheeky ******* I thought. :D
 
Interesting point, and not disimilar to a situation I noticed in my local supermarket carpark earlier this week. A car was clamped and had a large notice on the windscreen saying that it was an untaxed vehicle. I said to my wife that I wondered if it was legally sound to take such action as it was not on the public highway. In theory the car could have been taken there on a trailer and then removed in a similar manner. Highly unlikely I know, but possible!
 
Just as likely , it could belong to someone who lived nearby and parked it in the Supermarket car park , possibly since before the end of the preceeding month ( if that was when the tax expired ) . Whilst this may contravene the T&C of the car park , it may not neccessarily be an offence for the car to be there without tax .
 
If the supermarket car wasn't taxed, I doubt there would be a SORN .............. or insurance ................ or MOT

Realistically, we must ensure our vehicles be roadworthy and legally covered to use on the road.

I'm all for crushing the cars of those that breach the tax / insurance / mot requirements.

What if they ran into your pride and joy ?
 
i'm sure you can park a car on the road without tax as long as one of the wheels are on an axle stand
 
i had a cavalier in my street without tax with the 2 front wheels on axle stands for about 3 months, the car had no tax, i seen the police looking it over through the window and they did nothing.
