How could a prosecution be successful if a witness says they estimated the speed to be about 80mph.
Just like a regular report, without corroborating evidence there can be no prosecution.
Police definitely do get prosecuted for breaking traffic laws.
There was a successful prosecution a few years ago when a MOP followed a 'scamera' van through road works on the M77 well above the posted limit . So incenced was the aggrieved driver ( who had been 'done' by one of these vans not long before ) , that he followed the van all the way back to the RPU at Govan then asked for a senior officer , to whom he made a formal complaint .
Far from being fobbed off , statements were taken from the car driver and his passenger to the effect that they followed the van at a certain speed , as indicated on the car's speedometer , for a certain distance through the roadworks . Police then took the car out for a drive and , by referencing against the calibrated speedometer in a police car , determined the true speed indicated by the MOP's speedometer . On the basis of this , the camera van driver was charged and also disciplined - this was widely reported in the media at the time , a few years back now .
