Pothole Damage

A 30mph encounter with a small(ish) pothole...

£900 rear wheel buckled, tyre deflated and deformed :mad:.

The car is in MB Saturday to check if the front is ok, so it could get a whole lot worse :crazy:.

Has anyone been successful or unsuccessful in claiming for the damage in similar circumstances?
 
have someone phone local council now and complain about pot hole, make them aware of it, then call a day later and say you have sustained damage on said pothole. If they are aware of it they are responsible.

Not until the pothole has been identified, marked with paint and photographed.


I reported a pothole local to me (I hadn't sustained any damage, just preventative as it was difficult to avoid with oncoming traffic) within 12hrs the pothole area had been paint marked and within 48hrs been repaired..

I've done this thanks, and been give the number of the claims team at AMEY, the council's contractor (which I'm surprised about tbh as I thought it would be a claim against the council).

I've also done the photo shoot with rule in the hole etc. for the on-going claim.

There are some useful guides on the web as to how to succeed in a claim for damage like this. The gist of it is that for the LA to wriggle out of a claim they must demonstrate that they have an "adequate" inspection regime in place for that road, that they have had no reports of a pothole in that location, or if it has been reported then the report was so recent that they couldn't reasonably have been expected to inspect / fix it in the interim.

I'll give strong odds that even if they have failed on any of those points they will initially reject your claim, so keep on at them.
 
Had a like problem on the Phaeton. No joy with my claim.....I hope you have better luck.
 
had the same problem a few years ago wrote a couple of letters but got fobbed off however a friend of mind shortly after had the same thing and wouldn't let it rest and got fully reimbursed :thumb:
 
I lost my claim, even got the local MP involved, waste of time in my case. The council on the IOW are a bunch of shysters

I had the same thing a few years ago. Dark, wet night, pot hole hilled with water so invisible. Smashed wheel and split sidewall!

Next day I took lots of pictures, with tape measure for size comparison, and sent them to the local council, together with a quote for wheel and tyre.

After some toing and froing they paid for a wheel and 1/2 a tyre (they claimed the pictures proved mine was 1/2 worn).

A good reason not to waste your money on over priced wheels and tyres.

Never in over 30 years of driving have I ever damaged a wheel due to potholes, and I have been down some enormous ones that shake the whole car.

The biggest problem with anything like this is that it takes input, taking you away from getting on with normal life :devil:.
 
Both my father-in-law and I managed to drop into the same pothole in Sutton, so Amey involved then. Several phone calls, several emails later, my father in law received his claim form. Mine never came. We both gave up.
 
I hit a pot hole probably about 40mph down a country lane.

Alloy wheel was OK, tyre deformed not punctured but still had to be replaced, and 'shock absorber' was damaged. Was going to try to claim, but Toyota dealer changed the shocks under warranty, and I swallowed the cost of the tyre.
 
'Claims Direct' no win, no fee don't deal with personal pot hole claims?! :)
A missed market and diversification opportunity, and let them get on with it :)

I know what you mean John. Time is the problem as always.

Use their letter template. I got £700 back from KCC for a broken AMG rim and tyre.

Never in over 30 years of driving have I ever damaged a wheel due to potholes, and I have been down some enormous ones that shake the whole car.

Not a waste of money as John would have got his wheels with the car when purchased. Therefore he had no choice and I doubt he would want to put "other" wheels on his car anyway.

I take your point and I have replica wheels that supposedly will detonate at the mere sight of a pothole. In reality I recently hit a pothole and exposed drain at the same time. The result, the tyre was shredded and the wheel edge dented slightly. No cracks, no explosion, no implosion, in fact still using it a couple of months later.

John, I didn't claim for my tyre simply as I have been there before and experience told me you need luck and a lot! Of patience to proceed down that route. Hope you get it sorted soon, keep saying but it's such a nice motor and one I covet greatly.
 
I claimed for a broken alloy and holed tyre after a wet, dark night time encounter, it was a huge hole caused by unusually heavy traffic flow after a local major road was closed, there was a continuous flow of heavy trucks during the day apparently, because of this I thought I had little chance of a claim, but I did the obvious with plenty of piccies and a claim from from the council (Chelmsford), and about two months later I got a cheque for the full amount, so it does happen, and even without a fight.

After this claim I am now a regular on "Fix my Street" website to report problems, you might want to check on that site and see if your particular PH had been reported before.
