Single Yellow Line Parking

What if you cannot find a sign that displays the restrictions and therefore cannot be sure?

Well you have two choices ... park there and hope it's ok, or park somewhere else where you can be sure!

I would personally do the latter, unless it was a dire emergency and the risk of a ticket seemed worthwhile.
 
Wow, this thread has grown fast!

I couldn't find ANY signage beyond that of the pay-and-display bays; not only, the three other people in my car couldn't find any either (one being my Italian cousin, who even looked when I parked there - especially when I confidently said "you can park on single yellow lines on sundays and after 6:30..." she didn't believe me so she had already looked when we arrived)

That said, Camden is one large controlled zone - so I'm pretty sure that if I were to contest it I would be told that there is a sign two roads down saying I'm entering a controlled zone.

In addition to which, I'm leaving Friday to go on holiday - all in all, I feel quite "annoyed" (to be diplomatic) and don't think its very fair - but its less hassle to pay the £50 than to contest it.

Live and learn...

P.S. I will include a letter with my cheque stating how unfair I feel that stretch of road is, and that under slightly different circumstances I would have contested it...


write in contesting the fine and tell them you will be away ...they will write back telling you why you have to pay -- this wont hit your mat until you return...and the time period wont run until it does (for doubling the fine)
 
I had a similar experience in Brighton a while back...but they towed the car!!!

I appealed, and included a video that showed the route that I drove into Brighton which showed that there were no signs on the route that I took to parking the car. Made no odds as I was within the CPZ, and I lost the appeal.

It was interesting to note that a sign was erected abut 2 months after my appeal (it's on Mrs E's route to work and she took a photo that we compared to the video and it's was a new pole and everything).

I no longer go to Brighton - if Mrs E insists then she drives and takes her car.
 
If no signage is present, and a PCN is issued, and you can prove no signage is present then go to NPAS or PATAS (in London) and the adjudicators will surely rule in your favour (it's a simple balance of probability technique that's used).

Who do the adjucators work for? Are they independent or do they work for the council . And who directly or indirectly pay their bills and wages?

They may say they are independent but are they really?
 
Thanks for the advice - and even with the extra time I would get because I would be away, I'm still iffy on contesting the fine.

It seems whats fair and what really happens are two independent things - I can't find a single person who under similar circumstances has won their appeal - signs or no signs...

I have a little consolation in that if we had taken the tube it would be £12 for the daily travelcard each on peak hours, x4 would be £48... so it isn't too bad... (I know it doesn't make too much sense - in part its that I don't feel like going all the way back to take pictures, then make a mess, then possibly goto court, etc etc).

On a positive note, I have my interview with Oxford soon (for a post-grad degree), just got the email ;)

Camden is not the most efficient Council.

I got a penalty notice for being in a bus lane. I challenged it as the photos weren't conclusive. That was over 4 months ago. Nothing from Camden since I challenged them using the web facility

They may say they are independent but are they really?

Councils indirectly pay their wages through a fee added to every PCN issued (whether it goes to adjudication or not), but make no mistake, these guys really err on the 'side' of the motorist. On the 51/49 based test, most councils generally don't "win" - if there is any doubt for the adjudicator and the council cannot guarantee reliability of evidence or prove conclusively to any contrary, then the appeal is awarded.

Just went online to have a look at the pics they took of my car... there are 6 images online, 3 from the front and 3 from the rear. I must say, the resolution is WORTHLESS!

In none of the images can you see a sign though...

just checked my papers .. I submitted appeal on 17 Oct 06 .. more than 8 months ago. Shows how useless my memory is.


It has to be reasonable - 6 months is considered "reasonable" generally
