Wrongful arrest, have we got a case?

A perfect lesson in when to NOT arrest a person. Really sorry that this happened to you. You'd could consider engaging in a legal process, after following a very clearly defined process of complaint, as detailed above but would probably not need to as the PCC have a very good system in place for this very reason.

This is a perfect opportunity to learn more about your rights and I hope you can do this without becoming yet another anti-state etc reactionary. From what you have said, there were too many missed opportunities and arresting you for not being certain, is utter nonsense!

I hope you can be bothered to pursue this appropriately but make sure you direct your attention to the appropriate people concerned and not to every Police Constable or those in support roles.

You were able to provide detailed information at the time and if anything, because there was a doubt of consistency, the constable could have issued you with a notice to provide further information at a designated Police station at a later date.

As far as notions of 'Police state' etc etc etc, I always suggest that people who obviously have no clear understanding of what this means, try to visit a 'Police State' before comparing the British Police Force and what we really have here in the UK, with such a thing.

Just a quick update, forgot all about posting this on here.

Received a letter from the police complaints authority in April via my solicitor informing us that it had received my complaint by way of my solicitor, they were investigating and have also had written statements by myself.

I informed my solicitor that I will drop the matter if I receive some form of apology from the Chief Constable regarding the way we were treated by his police force.

Not heard anything since so I am just waiting for a reply, they certainly don't rush do they?

All I want is an apology either in person or in writing and that will be the end of it as far as I am concerned.
The IPCC will take their own sweet time and have received a lot of criticism over their performance and impartiality in headline cases such as the death of Ian Tomlinson at the G20 demonstration last year. Don't expect too much from them but they may do a decent job in this case if you're lucky.

As well as a full written apology from the Police and an explanation of their mistake you should at least press for re-imbursement of your taxi costs as a point of principle.
 
Don't hold your breath re IPCC. they have their hands very full and have had for some time. This reflects the increasing amounts of crap 'Policing' going on. I don't doubt that there are serving Police personnel who shake their heads in disbelief at such events.

Wrongful arrest is bloody serious! The constable must be able to prove that he had serious cause to arrest you.

Consider your options wisely and do not underestimate the seriousness of the apparent list of procedural failures made by the constables at the time, their sergeant, the desk sergeant....apologies are too cheap and do not ensure the same mistakes are prevented.

You're being extremely lenient, in my opinion and that is entirely your choice. Nobody else but you will have to spend the time pursuing this. I would, however, request a list of the procedural failures which were made, while bearing in mind that I would not be grinding any axes, just being very clear that innocent people do not tolerate such fundamental errors from well paid and highly trained professionals and that we do expect just and fair responses.

As Scott_F says, the bare minimum would be equivalent financial reimbursement for the nonsense you were subjected to.

I'm just a bloke on t'internet, but I think you should consider yourself lucky... you spent less than 24 hours in a cell without charges, immagine the poor souls who spends days, weeks or months before charges are pressed...

Democracy is not what it used to be - and there is no such thing as innocent until presumed guilty... my court case made that blatantly obvious...

your only allowed to spend 24 hours max and that is in extream cases if nothing happens you get bailed to your local station. then bailed to your local magistrates
