Quite correct, any road used by members of the public that isn't closed at least once in 24 hours is deemed part of the public highway for enforcement purposes.

Be aware also that local authorities now have the power to remove a car off your front drive after sticking the appropriate notice on it so don't leave that project where it can be seen.

isnt that tresspass? I own the area of my drive so they have no right to remove an untaxed car from there

They would , of course , require your permission to enter your private property in order to affix said notice . If they do this without permission , service of notice is invalid and any subsequent removal is THEFT . Go after council CEO as he/she is ultimately responsible for the illegal actions of subordinates .
 
Not true. When you buy your tax disc at a post office, they read the bar code from the disc with a scanner. It's instant.

They could have avoided the £60 by saying it had fallen on the floor.;)

First point is not quite true the bar code only allocates that disc to the reg and then logs it onto the Post Office database, then this gets transmitted to PO HQ and then inturn gets downloaded to DVLA, there can be numerous processing delays in the system that sometimes mean the DVLA cant confirm if you bought a disc at the Post Office or not until well after the event. I would expect under normal circumstances it should take no longer than overnight or a couple of days, but the DVLA aren't exactly known for their efficiency.

Same is true of the Motor Insurance Database (MID) when I put the private plate on my car 6 weeks later it was still not on MID and I got pulled by the boys in Blue, fortunately the certificate was with me as I had checked and knew it had not yet made it onto MID.

Totally agree with your second point though and thats the line I would have taken. ;)
 
There is a difference between the definition of a road for the purposes of the commission of the majority of Road Traffic Act Offences (a place to which the public have access etc etc - and which MAY include a private car park), and the requirements for Vehicle Excise Licence (Tax Disc) which requires the location to be repairable at public expence (so NOT a private car park).

If an Officer saw the car driven off the public road and into a private car park, they could issue the ticket for failing to display a valid Tax Disc as they had witnessed the offence being committed (on the road, not in the car park!).

Failing to display is still relevant in that I have 2 cars, if I tax 1 but display the disc in the other, I commit an offence when I use the taxed (but not displaying) car on the road. So even with access to the database, this is still an option (and surprisingly common!).

The old arguement that a tax disc was evidence of an MOT etc isn't really one that holds water any more - I think put the tax on the fuel (and make the user pay) would be more appropriate now?


Btw - I have 2 cars, registered X1XXX and X11XXX - you'd have to be pretty damn observant to notice at a glance when the disc for one was displayed in the other. ANPR does mean I'd not get away with that for too long though (and damn good job too - if I pay the tax, why shouldn't Billy Criminal?).
