E350 cdi gearbox leak. Warranty

Hi sorry if I've posted this in the wrong section.

So my car goes in to the main dealers for its annual service this time an A service
They then ring me a tell me the gear box is leaking form the sump pan gasket. They ask me what I want to do but they can't do nothing now as they are to busy! there advice is to re book it in after the Xmas period they advised me that Its safe to drive!

So I go to collect my car A service carried out. and on talking to the service personnel she tells me i will have to pay for an investigation in to the matter in question, I then tell her what needs investigating as you have already told me the faulty part in question plus you have sent me a video clip of the leaky gasket! After a lot of back and forth she agrees they will investigate the matter for free! Wow like I'm meant to be happy you just tried to rip me off I think to my self. She then goes on to tell me any work carried out I would have to foot the bill! That's fair enough but this is my problem.

A little insight.

My car is 2011 e350 cdi full main dealer service history. It's only done 4000 miles since its last service, B service + gear box service. To perform this service they have to drop the sump pan off to access the filter in the gear box.

So this gets me thinking

1 they have replaced the sump pan with the old gasket when it should be a new one.
2 the new gasket is faulty. mercedes benz parts carry a 2 year warranty
3 on refitting the sump pan they have not torqued it down properly
4 utter incompetence they are the only people to touch the car and the part in question should have been replaced by them as part of the gearbox service one year ago?

Where Do people think I stand on this matter? As I don't believe the fault lies with me?

Also how long is the warranty period of any work carried out by Mercedes Benz main dealer?

If the gearbox was serviced last year and now they found it's leaking from the gasket I would be demanding they put it right free of charge. Think they have shot themselves in the foot with this one!

Then they have some explaining to do! Either poor workmanship or materials, their choice really.

Ask the dealer principal if they think 4000 miles and 12 months is the quality they aim for.

You'll probably find that they suggest leak is 'within tolerance' and doesn't need fixing :D

If no joy with the garage, I would refer it to MB as the car has a full dealer history and they clearly worked on that item 12 months ago.

OK, no need to get aggressive (yet!). Start by speaking with the Service Manager, politely suggesting that as they removed and refitted the gearbox oil pan when they changed the ATF and filter a year ago, the leak is most likely as a result of that work and see what he/she says.

If the SM is reasonable then they'll take responsibility for it and get it fixed for you. If they're not you still have an escalation path to the Dealer Principal.
 
Hi thank you everybody for taking the time to get back to me on this subject, I now fill I can approach this matter in more ways than one and of a non aggressive nature and actually get some where!

As well as the gasket the holding bolts on these sumps are a one use item so they would have/should have been replaced at service. And if they do drop the sump to repair they need new again. Something to ask them if they've done. Shows you know what you're on about ;)
 
I've had a similar thing to this with a Indie, but the car dropped all of its fluid after the box had got hot on the drive home from collecting it grrrrrr

They had overtightened one of the bolts, lucky no damage was done "touch wood" i personally would be worried about using it until the leak is sorted.

Hi thanks for your advice, MB told me it would be ok to drive has it's a slight leak.

Would I not get a engine management light come on if the ATF was to low? Or is there no such thing?

On my s211 the engine light only came on once i lost drive :crazy:
 
My guess is that it's probably weeping from the gasket rather than leaking heavily. If it was leaking enough you would see it on the ground I would have thought? But then again, if it's been leaking for a year, who knows how much fluid is left
