Sadly, Mercedes have no contract whatsoever with you, I'm afraid. From what you have told us it seems likely there was a manufacturing defect, but in the absence of goodwill from MB, which your repeatedly ignoring the service reminder has ruled out, your only recourse is the ombudsman, and I don't hold out much hope of success there.

The dealer to which you took it for a diagnosis is not to blame in any way, unless you specified a maximum amount to spend. They require payment of the outstanding bill; that's not blackmail, it's business.

If you default on the payments, and in consequence have a CCJ against you, it certainly will affect your future. It's not fair, but sh1t happens, and it has. I'd cut your losses and sell the car as is for whatever it will fetch. Selling it to the dealer might well be the only realistic option; how much will they offer you?

It's a very expensive lesson, and I feel for you.
 
The dealership are caught in the middle, you've gobbed off at them so they won't go out of their way to help, plus you've ignored the light on your dash telling you the car is ready for an oil change, your prospects don't look very good.


I would have to go over their head to Mercedes. I haven’t “gobbed off” 😂, I’ve told them I’m unsatisfied with how unprofessional they have been, work didn’t properly get started on my car for over a month, the customer service has honestly been terrible. Couple that with being lied to regarding the findings, things really just do not add up.

Like I said I have a meeting in the morning to discuss findings with them. I will put lots of the recommended questions to them and will likely be getting the filter and oil independently looked at. If I can prove that the lack of service did not cause the failure then I believe I have a case.

It’s going to be an awkward situation due to the vehicle having not been maintained correctly IMHO.

I mean, if the engine wasn’t particularly well engineered and suffered a failure, who’s to say that it would not have, had it been serviced in accordance to the manufacturer’s schedule? That’s not to say that’s okay, but it mitigates the risk if it has been properly maintained. Is the onus not on the claimant in this instance?

The warranty T&Cs will no doubt have something to cover this, and I’m sure MB will be able to argue their position quite clearly.

My point is, I wouldn’t go in all guns blazing with complaints to MB but looking to them for assistance at this stage bearing in mind you’re on the back foot having not kept to your side of the warranty/maintenance process.

OP - I’m not sure if you’ve already answered but have you ever topped the oil up during your ownership? Did it ever go to MB for any work/health checks etc regardless of the service?

Mileage at the time the car last visited a main dealer.
 
I just went on to that my mercedes and they want £605 to change oil and oil filter on a 2.1 diesel 🤣🤣🤣

That site will tell you the mileage of its last service done by MB other issues arnt on there
 
Ok I’ve found the cars mileage, it’s not 26k it’s 24,900 so even less. Can anybody tell me at what mileage should this car have been serviced?

Mercedes used to have an elapsed time [ 1 year ] or mileage driven limit - [which ever comes first ] service policy .

If it's the new Mercedes straight six diesel engine look on German sites and they are so I read having oil pump failure.

I can’t get this info online. It was last serviced in august 2020 and I do not yet know what mileage was on it then.
If you bought it in September 2020 at 9000 miles then it would have been there or thereabouts in August when it was serviced.

Like I mentioned this morning, in isolation going 16000 miles between services wouldn’t directly cause this unless a component failed or there was very significant oil loss due to the engine burning excessive oil (unlikely at this mileage) or there was a leak.
