I can’t get this info online. It was last serviced in august 2020 and I do not yet know what mileage was on it then.

It can be got from the Digital Service Book (DSB) by using the Reg. or VIN.
What's the Reg. number?

I'd start by knowing the exact service history.
A car with little or no Service History (on the DSB) and sold outwith the main dealer network would be very unlikely to see any form of contribution from Mercedes towards repair.

Look at it from another perspective, if we all knew cars would still be covered under warranty regardless of service we wouldn't bother with expensive services at main dealers. 😉

It had one service in august 2020 (3 months late due to covid and before it was sold to me).

I cannot remember the exact mileage of when I bought it but I’m thinking it was around 12k. I will know for sure tomorrow when I find out the mileage at last service.

It’s now done 24,900.

I have found that the engine is I believe a C292.

Well don't quote me on this because ive never actually looked through the small print. But yes i would say if Mercedes are giving a grace period/extended range between service intervals that could be taken as confirmation this has no significant detrimental affect, and may allow you to counter their argument that you had exceeded the service interval by mileage. I thought the extended service intervals also applied to servicing outside the dealer network but im not sure on this (to preserve a full service history kind of thing)
Hi , on my C207 the extended warranty allows me a grace period of one month or 1000 miles over the due date for the annual service.

But do you know this was a "proper" service recorded on the Mercedes system?
I'm struggling to see how you know this if you don't have the DSB paperwork!

If
Update; after doing some calculations I believe the car to have done around 12k miles since last service, not 17k.
You need the last registered service on the database not from jo bloggs down the road you have an issue with MB so if MB haven't serviced it then I'm sorry to say they won't entertain your claim

Yes it was done at Mercedes Stourbridge. I’ve had my calculations wrong.

The car currently has 24,900 miles on it, he’s told me it’s 2,700 miles out of service.

24900-2740=22,160

22,160-10,000= 12,160

The service was done around a couple of weeks before I bought it and I know it was around 12k when I bought it (can’t find paperwork 😩).

Assuming he’s saying that it had gone 2740 miles over on its 10k mileage this is correct therefore the car has only done 12k miles since last service.

Could well be the engine with suspect oil pump

Even with a knackered oil pump the arguement falls back to....

.... it's because you didn't service it sir

Or miss 🤣🤷🏼‍♀️

I’m giving up. The speculation shall end for tonight. I shall be back tomorrow with developments.

Either I’ll have hope or I’ll be completely F’ed!

I’m sure you’ll all not sleep in anticipation.

Thanks everyone!

Ouch! :-(

Just trying to work from your details, has it gone 17k miles since the last service (August 2020) with no oil change? How about oil top ups? I know MB did allow some flexibility on servicing due to the COVID situation a couple of years back but I don’t think that can be used as an excuse now.

I hate to say it, but if the engine hadn’t seized when would you have taken it in? Playing devils advocate, I know you’d said about the new year but it would have been pinging up for a service due since before last August (usually the ASSYST system calls for a service a month before, to give time to schedule it, so in July 2021?). It would have done this every day you drove it - and continued to do so every day since the service was due (exceeded). That’s quite a long time overdue and looks like you’ve covered quite a few miles also (exceeded the service interval both in terms of time and mileage).

Like I say, this is how MB will see it - and it’s unfortunate that the fault you have suffered could be intrinsically linked to the lack of servicing - ie possible lubrication failure or oil level etc.

Had it have been a faulty starter motor or water pump or something then I guess it maybe not such an awkward situation, but it doesn’t look good in these sorts of situations. No one on here can say that it would have still seized when it did if it had been serviced on time, you’ll never really know.

I’m sorry to hear of your woes and hope you can get some resolution, but in the context of balance I have to say I can understand both views and I’m not sure anyone can blame MB for their initial stance either, especially when the fault could be directly linked to the lack of servicing (oil condition, level and or condition of filter etc)

Hope you get something sorted out :)
Really? Total engine failure for going over the service time in a pandemic? Don't think so.

It’s going to be an awkward situation due to the vehicle having not been maintained correctly IMHO.

I mean, if the engine wasn’t particularly well engineered and suffered a failure, who’s to say that it would not have, had it been serviced in accordance to the manufacturer’s schedule? That’s not to say that’s okay, but it mitigates the risk if it has been properly maintained. Is the onus not on the claimant in this instance?

The warranty T&Cs will no doubt have something to cover this, and I’m sure MB will be able to argue their position quite clearly.

My point is, I wouldn’t go in all guns blazing with complaints to MB but looking to them for assistance at this stage bearing in mind you’re on the back foot having not kept to your side of the warranty/maintenance process.

OP - I’m not sure if you’ve already answered but have you ever topped the oil up during your ownership? Did it ever go to MB for any work/health checks etc regardless of the service?

You can check when it was last serviced at MB on www.mymercedesservice.co.uk if you’re unsure of the mileage (just enter the registration)

Good luck :)
Back foot? He's spent 42k on a nearly new car that shouldn't seize

I just went on to that my mercedes and they want £605 to change oil and oil filter on a 2.1 diesel 🤣🤣🤣

If you want the air filter changed its another £86
Fuel filter £146

That is mental
So true buy the mercedes oil from mercedes Newcastle on their eBay shop £40 7ltrs delivered. Oil extraction pump £10 from Lidl. Oil filter £7 fuel filter £47 pollen filter £25 . Engine is easy to service loafs of vids on YouTube showing how to do it.

Is that for any reason? As it had a battery change at Mercedes in august?
August 2021? So you took it to MB for a new battery 12 months after it's previous service but didn't get it serviced at the same time? Seems odd to me.
