My C55 Estate got whacked

The Motor Insurance Bureau is the name given to the scheme operated for claims against uninsured drivers - in essence it is funded by the insurance industry and normally once it has been proven that someone was uninsured the MIB will allocate that claim to a company to handle as though it was itself the insurer.

In the case of my sister who was injured by an uninsured driver the firm allocated was the car's actual insurer (girlfriend of the driver who was driving supposedly without permission). Because it is their actual money going out they fight a claim like fiends. Good luck.
 
At least it is some progress, and it looks as though some legal action will be taken against the guy. But I thought in such cases the police could seize the vehicle and send it for crushing...or have I been watching too much TV?

I would rather they left the vehicle and crushed the driver.
 
Heard an interesting snippet yesterday... There is said to be more than 10,000 fake UK Driving Licences in circulation

What makes that number surprising is that it's the estimated figure for fake licences in Sussex alone

Nick when I lived in East London the Police commonly referred to Communal Driving Licenses. The Practise of one member of the family taking a test on behalf of the rest of the family and extended family.

More recently in Kent a two day "traffic initiative" which stopped cars at random as the left the Isle of Sheppey and Cars driving into Sittingbourne found that (wait for this) 40% were un-insured.

This prompted a local politician to refer to it as having reached epidemic proportions.

The facts are simple:

The penalties if caught are paltry and act as no deterrent.
Insurance premiums for young drivers are at a rate that encourages non payment.

In my case the guy who hit me deliberately insured his car so he had a valid certificate. he then stopped the payments leaving him with a certificate but no insurance.

His car is valued at £250. I spend that a week commuting in and out of London.

So he drives for the cost of his petrol and nothing else.

Removing his car he loses £250 (but he has already saved that in fares etc)

He will get a paltry fine.

I have just been fined £400 for doing 61mph on the M25 (Dartford crossing) 3 points on my license.

They know it was me because my car is insured taxed and MOT'd and I admitted the offence.

The law is an ASS!!!
 
It's idiots like this (and a 2 year insurance claim that ended in court) that means I now ride my motorbike with a camera that records every journey.
 
By the way, the camera I use (Roadhawk Ride) is excellent. They also do version car version that starts when you turn the key, geomaps and date stamps the journey.

For anyone one does a lot of driving I thoroughly recommend them, if you have video evidence there is no argument who is at fault.
 
Kent Police called me yesterday.

They have now interviewed the guy who crashed into me. This was done at his house, with the car still parked up on the driveway. Bottom line is they have charged him with Driving with No Insurance.

He stated that he was "washing his car and was only moving it to turn it around so he could wash the other side". He denies that he had anybody in the car at the time.

I never wash my car with my wife in the passenger seat and my kids in the back. Each to their own.

He also insisted that I had admitted liability (not true) and that I was "on his side of the road".

The Police said it is all irrelevant. As he was on the highway with No Insurance, No Tax and No MOT. They also advised him that he may still be charged with driving without "due care and attention" as he has admitted that he "never saw me" due to a "parked car obstructing his view as he reversed onto the road".

The Police advised him that he should "not be reversing onto the road" as he has plenty of room to reverse in and drive out of his driveway"

He was still adamant that it was all my fault.

The Police were nice and I didn't go into all my frustration as they are acting on orders and have done what I always said they should have done (thee months ago).

So now to try and get my insurance to recover costs for me through the MIB.

Any pointers or help with that would be welcome.
 
Result, but 3 months and you had to push hard for it.

He'll probably only get a £60 fine at the end so quids in for him.

£200 and six points basic I think but he will probably have to pay it at 10p a year. What with the 'hardship' it will cause his family and all.
 
There is always a downside.


Since I complained about my case to the Police Commissioner I have now been fined £780 and 6 points on my license for speeding at 67 MPH in a temp speeding zone (50) on the M25. This is where the M2 joins it. I was filmed at 04:45am during the week the cameras were set up.

Having replied to the initial summons stating that I was the driver and it was my car I heard no more.

Now I have been charged and found guilty in my absence of failing to declare the driver and with speeding.

Should I just not bother paying my insurance and tax and MOT? Money saved may over the fine. Should I question how this happened after my complaint to the Police Commissioner.

Maybe just take my plates off and drive with impunity.

20 years with no points. Hmmm.
 
Unbelievable...the law truly is an ass...

Last year when I sold my CL...the new owner pranged it on the same day he picked-up...I had not cancelled my insurance and he tried to claim on it (due to him not insuring the car)...took 6 months to sort, nightmare, police not interested again...my only get out of jail card was a signed bill of sale document I had stating time and date he bought car, even DVLA were not interested....point is with these issues there's endless reams of processes and paperwork, everything gets bogged down and turns over really slowly...

There are millions driving with no insurance, mostly due to deep recession, millions on the edge as broadcast the other day...police cuts etc it all adds up.

Rant over...Pursue through legal cover...I really hope you get sorted.

No. Mostly due to feelings of entitlement and the knowledge they can. My only surprise here is the lack of reference to whiplash injury claims.

Finally getting it sorted at my expense. Decided to have the whole car spruced up.

I may fall in love with it all over again now. They are the absolute "sleeper"car and I can get my golf clubs in the back.

Don't fall in love with it , it's rubbish

Get rid of it as soon as it is finished , don't hang on to it , something may go wrong.
