My C55 Estate got whacked

I rather think it is time for you to write to your Chief Constable , copying in your MP and any councillors ( chairperson of the Police Board would be a good choice ) explaining all that has transpired - in particular that this car was on the public highway when it crashed into yours , that you have reported the matter to police and followed it up a number of times ; your insurer has informed you that the vehicle is uninsured ; you know it is still being driven regularly despite not being legal ; the local police are aware of this situation and yet seem to be taking no action - WHY ?

You might also mention that you are thinking of taking the story to the local and/or national press , but thought you would give him the opportunity to deal with the matter first .

Send that recorded delivery and I suspect things may just get moving .

I had a look on the DVLA site. The registration shows as "unlicensed"

Bruce , going back to the earlier part of the thread where you state the vehicle is unlicenced , you could also report the matter to DVLA stating that you have seen this unlicenced vehicle being used on the road , explain your interest in the matter and that the vehicle is also uninsured . I'm fairly sure there's a portal on the DVLA site for reporting such things .

If is is the case that the tax has expired and they have not declared SORN on it , then DVLA will be able to clamp it . If they were able to catch him on the road with it , they could impound the car .

I have mailed the Police Commissioner and await her response. I have advised of the facts and stated that I will go to press.

I am absolutely fuming.

Morethan have just returned my call and say that they will call he Police but that the Police have got it wrong as nobody was injured and they did not attend the initial accident.

I have to say that I believe that the Police are way out of line on this. I stand to be corrected. Can anybody on here advise on this?

My insurance company called the Police to report the lack of insurance.

They were told they have to put it in writing. No email must be hardcopy.

Meanwhile. The guy is still driving the car.

Un-frickin-believable.

All these processes put in place to "protect peoples rights" are just protecting the lowlife who drove his car illegally, hit you and then denied it.

Having said that I hope you can be bothered to persevere because I have the feeling that once the insurance and police processes kick in properly he will find himself suddenly carless and facing serious prosecution.

And I really hope he does because scum like that put us at all risk in an extarordinarily selfish way day in day out.

For example, I didn't know it was the sole and exclusive legal right of insurance companies to report cases where there is no insurance. I thought anybody with cause/evidence could do that. I also didn't know that the police would only accept evidence on criminal cases by post.

Bruce - keep fighting, but keep laughing...this must be killing your blood pressure.
 
Would certainly be writing to the MP. I'd be very tempted to go to the press if I didn't think it might just tip boyo off about what you are trying to do!

Blast them to your commissioner, police chief, MP and the Daily Mail.

My sister was knocked over and seriously injured many years ago by someone driving without insurance. Her claim for damages was immeasurably drawn out because of this, stress she didn't need and most certainly didn't deserve. It is a plague on society that costs all law-abiding motorists enormously.

From experience, I can say, the Police are incredibly lax when it comes to this type of situation.
 
A shame, as this one should be an easy win for them. In the same way posting a PC with a speed gun on my lane would be. A Ferrari 458 came down the lane the other day (a regular visit) at a speed I'd estimate to be close to 70. We are of course a 30mph limit.
 
The Police have told me this is a "lower priority" for them.

Two months and no action. I await a response from the PCC.

So if you live in Kent. No Tax, No Insurance, No MOT and crashing into people is a "Low Priority Crime".
 
As I said at the beginning of June, have you spoken to your MP, get him to rattle some cages and tell him /her if nothing gets done then you will go to the papers and make such a stink they won't get elected, that should work!
 
If you get no joy, I'd take it to the small claims court. You can then hire a Bailiff who will chase the money up for you. You can add all the time you have wasted in as part of your claim. The Bailiffs will be commission based, so you only pay if they get you money.

At the very least a bailiff at the door will piss him off. They don't give up easy.

Having written to the local Police Commissioner over a week ago I received a reply last Thursday. This stated that they had asked "the Police to investigate" and this may take some time. They have asked for my patience while the Police investigate.

Well, on Friday last week the pace really picked up. Hang on to your hats folks this could be a rough ride...

I got a call on my mobile with "Blocked" so I let it go to voicemail. Big mistake. It was from the Police - A PC xx. He stated that he had been asked to look into the matter and wanted to discuss the matter with me. He had been told that "I had been in an accident" and that it maybe that somebody had no insurance. He would call me back to discuss. He hasn't called back. Well lets be fair here. It's the weekend, you know when uninsured drivers get an amnesty to drive without fear of arrest. Oh no wait this is Kent where uninsured drivers get an amnesty all year.

My insurers just called me. They have attempted to report the matter to the Police (as requested by the Police) This has failed as the Police would not allow them to report it over the telephone. They have to put in writing on letter-headed paper (this is true).

So if in your travels today you come across a terrible crime. Get out your pen and paper, buy a stamp and head to the post office. Rest assured that at some point in the future the Police may take some action against you.
 
This must be so frustrating Bruce. Reading the whole thread makes me realise how lucky I have been with my incident.

A real eye opener as to how Kent police appear to treat an unisured driver so leniently. Had that been Dorset police, he would have been hung drawn and quartered by now.

The difference is that in Kent, everybody drives uninsured.

Is the "Garden of England" really that bad?
I know certain police forces have a big crusade at Xmas to catch dd offenders (Wiltshire police are notorious).
Perhaps Kent police are spending their man hours rounding up illegals around Dover:devil:
 
Here is the latest.

Almost three months after having my car hit and reporting it to the Police and Police Commissioner, today the Police called me.

They tell me that they are now preparing a summons for driving without insurance, tax or MOT. It appears that having visited the chap who drove into me he has admitted the offence(s).

Now the fact that he has continued to drive daily with his kids in the car and no insurance tells you something about how concerned he is. I suspect that resultant fine will be less than insurance costs.

The police have advised my insurers that following the summons being presented they can contact the MIB to try and recover my costs. Does anybody know wnything about this?
