I would also assume that at 40MPH this person was not overtaking anyone, which tells me the inside lane was also empty. So even if he wasn't using it, why weren't you ?
I would have just gone past on the inside. Passing on the inside isn't illegal, overtaking on the inside is. It is only an overtaking manouver if you change lanes to do so .

I believe the correct way to use rear foglamps is to turn them on when it is foggy and turn them off either when it ceases to be foggy or when you can see the headlamps of the car behind you. Red light passes though fog much more clearly than white light, so if you can see the headlamps of the car behind they can definitely see your foglights! Not only are foglamps annoying for the following car, they are the same intensity as brakelights, and I wouldn't want someone to miss my brakelights because they were distracted by the foglamps!
