Is wing rust (quite bad, see picture) an MOT fail?

Hi

Have a standard problem with my E300TD 1998 - driver's side front wing rust.

Is it an MOT fail? (I do plan to fix it and already have had the new panel for almost half a year but if not MOT fail I would much rather do it April/May)


Also I have the parking (low power head lights also called position lights) lights of different tint. Last year I got bulbs to make them more like modern Xenon based cars - cold white colour. It did pass MOT with those. But since that time I had to replace one of them and did it with the normal yellowish one. So the old one now looks kind of tinted if compared to the new old fashioned yellowish bulb. Is that an MOT fail?

^+1 have seen cars pass that have been gaffer taped over though.
 
Definite MOT Failure :( But Yes a Gaffer tape patch would get it through, though I would have to phone the Mercedes Police and report you for cruelty.
 
Definitely not an MOT failure with Duct tape.
 
I'd hammer anything sticking out in, and then duct tape...

Get someone to film it and then play it on a 70" screen outside your local MB dealer to customers.

Wifes 124 estate has had gaffer tape on bigger holes than that for approx 4 years and never any questions from MOT.
