Using this logic would give any MB dealer carte blanche to do any unauthorised work they wanted & leave car owner responsible for whatever the bill amounts to!

There is a grey area in this. If the non-warranty damage is only visible/detectable some way into the job then it's unfair to expect the dealer to carry all the can.

However the two issues here are (a) it was agreed that it be done under warranty and (b) they didn't chase the costs until after the car was accepted back by the customer.

The second part would appear to reinforce the supposition that they have been negligent in looking after their customer's interests and protecting *his* losses. Particularly as stone damage is external and should be visible on a component after it has been removed, if not before. In this case it appears the component wasn't properly inspected until after the customer had accepted the car!

It also seems a bit odd that an experienced service department wouldn't advise a customer before undertaking work that until they determined if it was subject to warranty there might be costs incurred.

My inclination would be to write stating the facts of the case from my perspective and be very specific about the instruction given and agreed to and raise the opinion that this matter has only arisen due to their negligence and make it very clear that you are the victim.

Then ask them to respond in writing as to how they propose to correct their negligence and provide evidence that this is a not a warranty repair - in particular that any damage to the removed condensor has not occured either during or after removal. At no time did they advise you of the cost of the replacement - nor did they advise you of any alternative remedy such as repairing the faulty unit. You did not authorise any costs at the start and were not advised of any or given the opportunity to authorise any costs while they had the car.

Then add a final comment about the disappointment and unexpected lack of professionalism and service given that you paid XXX for your car and the lack of trust you now have now you have been treated so badly.
 
Surely, the answer would have been as soon as the dealer realised their mistake to ring up and confirm that the job actually wasn't covered by the warranty and to get authorisation (or not!) to continue with the work as a paying job - before doing it!.... As they didn't, it looks to me that they don't have a leg to stand on...

I have just told them that i would not like the air conditioner condensor unit as it is far too steep. They tried to haggle down to £800, i said nope that is still far too expensive im not goin to pay as i cannot afford it right now. They said the last thing they want to do is to have the car back in. I said well thats the only option, i cannot afford that kind of cost right now and want the condensor removed.

I also told them they had to come and pick up the car from my garage and deliver it back lol.

He said he would give me a call back.... no response yet...

Phew - I thought you were going to let them have your car back, for a moment !!!

If they have your car, you will loose all your advantage.
 
I find it so sad that this dealership has not taken this on the chin and kept the customer onside, but...

I also find it sad that the op states they cannot afford the repair :devil::devil::o

I much prefer to be honest and very politely, very tactfully, butvery firmly, say

"On your bike sunshine"

Your mistake, your error.

I would then suggest how pleased I had been with the service I had always received from this dealership, both their sales and servicing has been exceptional and this issue is leaving a very bad taste. My car will be at a specific location at a certain time, they can come and pick it up, they will have to leave me a comparable vehicle whilst they remove the part in question and I would appreciate any fuel used in taking my car to their service department be replaced,

No doubt you genuinely cannot afford the repair but it just reads bad that someone who openly states how they have purchased a £150,000 car cannot afford this repair :)

What ever you do..... Do not wear those tyres out :) They cost a fortune (apologies for my humour and apologies for my flippant attitude) I totally agree with your stance and wish you luck
