Near miss... Help needed

Well bad news. I received a letter from the Vauxhall driver's insurance company today. Basically informing me of the fact they are trying to make a claim against me and for my version of events. Will speak to my insurance in the morning and see whats the best way of dealing with them :(

The insurance company have probably just sent you a standard default letter informing yourself that they wish to make a claim against you without knowing the full facts and hoping you will give in. If you have legal cover then you can just inform your insurance company of the incident and advise that you would like things to go no further and request for a Solicitor to be appointed who will deal with all the litigation (this will not affect your no claims bonus). Its probably going to have to go all the way now to Court unless the claimant’s solicitors see sense and advise to drop the matter at their own discretion. They may try and be clever and ask for an out of court settlement (that’s an old trick…).

OK. Spoke to my insurance again. As i paid extra for the legal cover i have to send the letter from the other company to them. They said they'll write back to them directly.
They said they won't just pay out and the other company will probabluy have to take me to court to try to get a payout. They have contacted the policeman at the scene and the chap that accused me of hitting him in the back admitted to him that he wasn't 100% sure it was me!! So why is he trying to claim against me???? So much unwanted hassle!

Now that his said his not 100% sure it was you that will def go against him should it even go to Court... keep a full log of events, time and date etc.

Its unwanted hassel but so far is going to plan in your favour - mine was far worse and hell all the way from beginning to end, and the Judge did favour the defendants considerably more in court as they were two women (together) that had done the dirty (but I sued them after..) but I only survived becuase of my two star independent witnesses. My Solicitior even said had my witnesss not been there or were of an ethnic minority group like myself then it was looking to go all against me!!!

Keep a list of all of your phone calls and visits to the bodyshop etc and at the end of it all present the idiot with a bill for all of your time etc, make it big enough to sting and maybe he will have to sell his car once HE fixes it. Get one more idiot of the road. I was told once that if you dont file a claims form with your insurer they will not pay a penny to anyone, thus making the onus on the to**er to take you to court and suffer the cosys accordingly.
 
Well i'm not happy about the way things are going at the moment. I wasn't involved in any incident with this chaps car but yet he's trying to claim against me!!!
I've got his address, and i can tell you that i'm barely stopping myself from doing something which i'll regret later. I don't like to be accused of something i haven't done, and i certainly don't like someone that starts a conversation with F off. And the fact he's like a 5ft 2 midget.....

Try and stay clam and o not approach him just yet - even if you went round to have a friendly word he'll use it against you in court - that happened in my scenario.

courts take a very very DIM view of people who take the law into their own hands ... best keep calm and let the process grind through. It'll be good for your soul at the end of the day ...
 
Thats the only reason i'm stopping myself!
I also received a letter from his solicitor just informing me that they will be claiming against me for "uninsured losses" as a result of my "accident". WHAT ACCIDENT??

I would have thought the driver of the Ka would have reported a 'hit & run' accident involving an Astra at the same time and place as your incident... you'd think the Police could put 2 & 2 together???

Just a thought, perhaps the Ka driver wasn't insured, so he's keeping quiet. :devil:

Because the Ka driver is long gone, you are his only hope of a payout.

If I was you I would have absolutely no contact whatsoever with this guy whether it be written or verbal. Your Insurance Company is now acting on your behalf so step back from everything, try and remain calm and let them deal with it.

Things may not go all your way initially and you may get the odd letter that angers you but ride the storm and it'll all work out. There are obviously no grounds for this claim so hopefully matters will be resolved quite quickly for you and you can 'move on'.

In the meantime if he tries to contact you I wouldn't involve myself in any form of conversation with him and no matter what your own feelings are I would politely refer him to his own insurance company if he has any 'issues'...you'll feel better for it!!!
 
1. if he wants to claim make it known that any forensic paint tests done on his car, even basic inspection should tell that the paint is not your paint, besides the fact your car has no damage! So it's very important that he doesn't dispose of the evidence and get his car repaired.

2. keep professional and firm

3. could counter claim/sue for damages/libel/taking your name in vain/false accusations :) ?

I haven't heard anything back yet from anyone! So fingers crossed! Will update you guys as soon as i hear anything.
