Then they'd come after the driver to reclaim their losses.

I understood the third party element could never be invalid but I would imagine the first party element of the Merc owner's insurance might be interesting.

Always talk on here about the slightest thing and insurance companies won't pay out.

I blame the Merc driver 100%. Clearly care taken by the LR driver approaching the bend. Merc driver far too fast and didn't even start to brake.

Agree with MJ on the cavalier attitude.
 
Has the insurance company seen the film?

Do they accept dash cam evidence?

Therein lies your answer.
 
Land Rover going slightly too fast for the conditions/nature of the road initially, but noticeably slowed before the right hand bend and actually came to a halt before the Merc came around the corner far too fast.

100% Merc fault, lack of MOT would have nothing to do with culpabilty.

Pretty shocking.

But not surprising. We've had an insurer try and impose a 50:50 for a no fault - it took a fair amount of shaming them to get them to shift and get things sorted. I no longer do business with them.

However if this is true I'd like to know the name of the insurer. If it's my current insurer then they will not be getting my business next renewal.

The same company covering both cars(even under different names) sounds like the most likely scenario to me.
 

Which suggests, as I said in my post. Insurers treat collisions on single track lanes as 50/50 by default. That has "always" been my experience living in an area where there are only single track lanes.
 
Well call me old fashioned but any driver going that speed on a D road has to have a retest,they are both driving too fast,but yes the Merc driver is at fault,he was the one coming round a blind bend at speed,but this is what is happening these days,people drive too fast,you see it around here on single lane A roads people drive into a bend wanting and needing to use the other side of the road and when they meet a car on the other side panic sets in they straighten out flirt with a ditch,and curse the car that was in the right on it's side of the road.
 
From watching the video I'd be inclined to say the Merc was at fault. Land Rover slowed accordingly for the conditions and if the other car did the same he'd have stopped but just appeared to have zero caution.

50/50 seems like an easy opt out for the insurers in situations like this. Probably works out cheaper than fighting it.
 
Merc driver seems to be going quite fast for the road / blind bend
