Or as I said earlier, try and claim from your credit card/bank that is linked to Paypal if Paypal won't consider it - you have nothing to lose!

In the same way that Si has no claim over the courier, the card provider has had no dealing with the vendor, only Paypal, who it will have paid.

It's worked for me and my father in the past and as the item is from a business and not of saleable quality, it may work for him after all he has nothing to lose!
 
Shame you didn't manage to get this sorted Simon. I feel your frustration, bought some RH Toplines in need of a 'refurb', all the pics he sent were spot on. When the wheels arrived and I eventually took them for a refurb, the company told me two were no better than scrap! When I contacted the seller (who was an absolute gent throughout the transaction) he said they could be refurbed and wouldn't change his stance on it. I also paid by 'gift', as I have do e several times, but this was a 1st for me being stung. Oh well, you live n learn!

PS how did you manage to get the sellers address?? ;)

I knew I wasn't the only one to have done such a deal outside ebay etc...... It only came about as I asked for more pictures and then the seller offered to do deal outside ebay at less price which of course is attractive assuming all goes well. Being honest I've done a few similar deals in the past, none of which were suggested by me and the purchases have all been good. I guess you just have to take the rough with the smooth as such.

I suppose I just generally trust people to do the right thing and in this instance I feel I have been let down. It's not the end of the world and isn't massive outlay and at least I can use the airbag part, so my loss isn't as great as it might have been.

Parcelforce gave me the address from which it was dispatched which was a business address (SW of Leicester). Some of the sellers stuff is listed as collection only so his home address (SE Leicester) wasn't that difficult to come by either with a little help ;)

Sales of goods act does not apply to private sellers unfortunately:

That's interesting. Perhaps Paypal had been used in the correct way by you and your father in the first instance, so were happy to co-operate with the card providers, but in this instance, Paypal has been used against its terms. I don't see how the card provider would refuse to reimburse Paypal, who have already forwarded payment as a "gift", but as you say, he has nothing to lose, other than exposing his co-operation in doing Paypal out of their commission. This may sound harsh, but it is how they will view it.

Possibly but I dont think paypal or ebay care that much about small fry stuff, its the bigger ones they care about and as most of their complaint processing is automated, even these get through, you never know!

But in the end its Simon's money and his choice of action that he takes and although I couldn't advocate sending "heavies" round as suggested earlier, it's still his choice whether he trys other methods or not or does nothing and takes the loss, all I was suggesting is try if it doesn't work the worst that could happen is that they close his eBay/Paypal accounts - no big loss IMHO as you can open another one IDC

Paypal have not been done out of any fee's as the OP had paid it as GIFT, he would have prepaid the PP fee's on behalf of the recipient.

Sorry, that must be my misunderstanding then. I thought Paypal charged a fee for business transactions, or payment for goods, but not for gifts?
 
Paypal used to give the option to the sender as to who pays the fees for 'GIFTS', either the sender or the recipient. This changed a while back and now it does not charge for 'GIFTS', providing it is to someone in the UK.
