I ended up calling the lawyer, apparently the lady in court was right; I don't need to fill it out... And I was already wondering what to write :P

Well, its all sent off and now I wait... Don't yet know when its due to be heard - we shall see how it all goes

Sorry for not replying to the forum last week as I have been away. Being qualified and practice in criminal law, I would advocate that when you do go to court (if it does indeed progress - dependant on CPS and subsequent disclosure etc), be clear, succinct and dont waffle in the witness box, look at the individual asking you the question and direct your reply to the bench, I know this sounds odd as human nature wants you to answer the person who asked the question, this is good court etiqutte (and it means that the Judge / Jury or Magistrates can hear your answer clearly). if you dont know the answer, then say so, dont start a lie, advocates are trained in a slow bleed of questions that can wrap you up ina bundle.

My adage in court as a prosecutor is to ask a question you know the answer too, but want to set up the question 2 or 3 that are ahead to show a lie or doubt, or indeed confirmation. Keep your answers short, dont guess the question if your unsure what has been asked of you, if you dont understand the question, or which element of the question, ask.

Courts are public buildings, go along one day to watch, all have an area for public to sit and view, when I did my studies I would often go to watch a good stabbing (apologies) or deviant crime.

Dress smartly, dont be cocky. People act strangely in stressful situations, if you are a fiddler/fidget, hold you hands behind your back and focus forward. Dont shuffle left to right etc in the box with your feet. Keep a straight back, look confident and assurred.

Anyway, your brief should be giving you all the advice you need, as well as links to specialsit agencies whom specialise in RTA reconstruction. presumably the biker will be called as a CPS witness, so their statemnt in disclosure will tell you a great deal, as well as the Police report.

Having been to court a few times, once in the dock, take a friend with you for some moral support. As mentioned above, dress smartly, be polite, speak clearly and concisely.

Make sure that you and your lawyer have all the information you need, and that you know what course of action your lawyer is going to take (prove your innocence/prove guilt of the biker/prove inconclusiveness of the evidence)

Best of luck, when this is over you'll only have to worry about Italy's performance in the world cup! ;)

Sparky, unfortunately, Italy won't win. I know it. The players wont have their minds on the game considering that half of them are involved in the Moratti-scandal... oh well, I guess the Brazilians have a good chance...

Four months since the last post and no-one's asked 'What Happened?' Did Michele - Spinal - get carted off to the lock-up? Was the case dismissed? Did he win? Does anyone know or care?
 
Yes, Birdman is amazingly in tune with the woefully and tortuously slow machinations of the British legal system. Spooky!

It is rather spooky, prp...., especially since I only chanced across the original thread today, read it right through (esp liked the bikers v motorists fistycuff bits) and presto! it's hi ho, hi ho, and off to court we go.

I reckon it's case dismissed, inadequate evidence. And nearly no-one loves a biker on this site, in court, or anywhere else (sob!).

But what do I know?

Hey, I'm a biker too! My "primary" mode of transport (following the tube, which isn't really a mode of transport but a quick way to shorten your life expectancy) is a motorbike... a small one, but a motorbike none-the-less...
