SLK 200k mot fail on emission test

If you failed your mot there remainder of your original mot is quashed.

Not my understanding of the situation, I was told I now have 10 days following a failure. This would allow folk to get tyres and such that are difficult to get ( the example they gave at the garage).

One of the few things that make some sense to me!

This is a direct copy from the VOSA WEBSITE. My quote from info from the garage would appear to incorrect information. Though part 3 of the VOSA site does mention something about 10 days, it is not very relevant.



If your vehicle fails the test
You’ll get a ‘notification of failure’ from the test centre if your vehicle fails the test. The failure will be recorded in the secure central MOT database.

You can still drive your vehicle if it fails the test and its existing MOT certificate is still valid (ie you got it tested before the expiry date). However, you might be stopped by police and prosecuted if your vehicle is unroadworthy.

If the vehicle fails the test and the certificate has expired, you can only drive it to:

have the failed defects repaired
a pre-arranged MOT test appointment
Your vehicle should be retested at the same test centre that did the original test.

I would find a garage that understood the MOT regulations.

As stated ;a failure during an MOT carried out whilst a valid certificate is in force for that vehicle does not invalidate the pre-existing pass certificate. There is no 10 day rule, the garage that gave you this information, if the hold a licence to issue MOT certificates, should know better.

I stand corrected, it must have been on the "list" they keep producing for new failures, but never implemented, there argument was if a car fails a mot it is classed as unroadworthy therefore should not be on the road until fixed so you would lose the remainder of your mot.

If a car fails an MOT (a minimal safety check) then it's deemed unroadworthy regardless if it has a current cert or not. It's the same as if you get pulled over and the police check your car and it's deemed unroadworthy you must get it repaired in 14 days and not drive it until it has been repaired.

Something like a frayed rear seatbelt would be an MOT fail - does that really render the car unroadworthy and mean it cannot legally be driven??

I thought they could categorise fail items, indicating which ones (if any) rendered the car unsafe for use on the road.

If it fails, it fails. Any cause for an mot fail deems the car unsafe to use on the road.
 
All done, new MOT, turns out it needed reprogramming. £100. I can highly recommend RH Motors in York.

Well done, you're MoT'd and only had to pay out £100 and not £750. I'd call that a result.

When I bought my SL several years ago it had been MB main dealer serviced all it's life.

I don't trust main dealers with older cars so I took it straight to my indie. To get it mechanically perfect cost me over a grand ,(nb this car had always been serviced at main dealers all it's life!).

But it was worth it as virtually nothing has gone wrong since, all it's cost is servicing and consumables.

They can and do. The tester is obliged to give you written notification of any defect which renders the car unsafe to drive. If no defect giving rise to such a notification is identified, unless the rules have changed recently it is legal to drive the car home after having failed an MoT test.

Unless, of course, someone knows different...
