Using a telephone whilst driving carries more than a £60 / 3 point penalty

I may have misunderstood you but why does the value of the car have anything to do with the crime. Is there an axe you have tio grind with someone who has an expensive car, do they have have "less of a right to commit a crime" than someone with less money?

I think the implication is if you can afford a £50,000 car you can afford a handsfree kit, unless of course the owner thinks owning a £50,000 car puts him/her above the law.

But if you can afford any car you should be able to afford an hands free kit. If you can't no speak and drive...

1. It is not illegal to eat while driving - it may be that you commit the offence of not being in full control of the vehicle, but eating per se is not against the law, neither is drinking.

2. If your business is that important, then employ someone who can make decisions in your absence just like they used to do in the olden days.

Tank of diesel £100. Bluetooth headset and a stick on phone holder £30.

Oh i know but you hardly see the police cracking down outside the mcdonalds car park...

I'm sure I read somewhere that a company should not phone an employee when they know he/she would be driving if no handsfree kit has been provided.

The correct guidance for risk purposes is that all employees provided with a phone and car must be told in writing (via the employee handbook or other means) that calls must not be made or received while moving unless using a hands free device and a mounted phone unless necessary to call the emergency services. Also they should consider the risk of making and answering any call before doing so. Employers certainly should consider any vehicle driver who has a phone should be provided with a hands free device, preferably a fitted one with correct cradle, as part of their equipment for work.

Personally as well, having run a small fleet, if I were doing it again I would insist on all drivers having a day of driver training and assessment before being authorised to drive a company vehicle.
