560 SEC with no ac?!

Fellow members, how many 560 SECs have you ever seen that didn't have ac?

mercedes sec w126 | eBay

Yeah can't be a 560 then, came as standard on them. I don't think it says the engine size anywhere in that ad. Couple like that on eBay at the mo the, seems a bit silly.

Gorgeous looking car though. Might be a 420.

Yep it's showing as a 420

Somebody has swapped the 420 badge for a 560. The owner does not anywhere claim it to be a 560, so giving him the benefit of the doubt, he may just have forgotten to mention the incorrect badging.

I love the colour.

You make no mention of the model in your description. Is it a 560?

Thx.

Is a 420 sec w126c . Boot badge is 560 as when repainted old badges broke and at the time I couldn't find the 420 sec badge . It has v 5 present and you can hpi the car as you have the number plate in the pictures .

I question why would you do all that work and not fit correct boot badge to keep originality, he could have easily of sourced from MB:crazy:

How closely do you look at the V5 when you buy a car? Do you check the engine size and model? I don't usually, and I bet most don't. A mug buyer, opening the bonnet and seeing a V8, might well assume it was a 560. Hmmmm.....

IMO he is clearly & deliberately misrepresenting the car as a 560.

How many car ads do you see where the seller does not actually use the model name anywhere in the description?

The correct boot badge from MB is also relatively cheap to buy. I've bought a few down the years myself and compared to all the money which the ad says the car has had spent on it the badge is peanuts.

I must admit, since he's the one who changed the badge, I'm a lot less inclined to give him the benefit of the doubt.

Legally, he's not. I wonder if the buyer will ask/notice before paying/

Because nowhere in the ad does he state what the engine size is, or what exact model it is; all he says is that it is a Mercedes W126C, SEC, and V8, and it is all of those. The ad is (I suspect deliberately and carefully) worded to allow any potential bidder to make the assumption that it is a 560, but does not explicitly state that, so no misdescription has occurred.

A buyer may assume that it is a 560, but the seller is under no obligation to state otherwise unless asked. Sharp practice, but lawful. As it's a private sale, "Buyer beware" applies unless the car is not as described, though I think even if it was a dealer selling it, legal action for a refund on grounds of misdescription would be bound to fail.

It looks rather nice, and if all the work described has actually been done, it could well be a pretty good buy at the right price, though you would want to get the sunroof sorted. If you wanted to race other cars on today's roads, you wouldn't buy one of these; in a car of this age, the performance even of a 560 isn't going to set the world alight, and even the 420 still has a big lazy V8 under the bonnet and makes all the right noises.

If I wanted an SEC of that age, I'd at least go and see this one, though without aircon, I'd not want to pay too much, and the lack of aircon might indeed be a showstopper. I wonder if it will sell, and if so, how much for?

1. ... nowhere in the ad does he state what the engine size is, or what exact model it is ...

2. The ad is (I suspect deliberately and carefully) worded to allow any potential bidder to make the assumption that it is a 560 ...

3. It looks rather nice, and if all the work described has actually been done, it could well be a pretty good buy at the right price ...

1. I disagree. The car carries 560 badging which the seller applied and displays in the photos which form part of the listing.

2. There would be reasonable grounds for arguing that in so doing, the seller has misrepresented the car - see http://www.legislation.gov.uk/ukpga/1967/7

3. I agree.

1. So if the car were badged "C63 AMG", you would consider it was being sold as a C63 AMG?

2. See 1. Go ahead and buy it and sue. Good luck; let us know how you get on... :D

3. Good.

4. I've always wanted a Pegaso, but never got round to buying one. What's it like?
