Why not get the car inspected. This is the route Mercedes would go down any way in the end. I would start with a company by the name of Dekra, they normally charge around £200 for an inspection and report, these reports cant be argued with. It may also be worth getting the Ombudsman involved as well however they dont rush and it can be quite long winded.

Further to our telephone conversation on the 12/12/18 at 12.11 we spoke about having an independent garage to look at the issue for a second opinion as it does not make sense because the vehicle is ONLY shaking on cold start, you even told me the costs will be covered for an independent report after i had said "i am not made of money".
I then called you back back 15/20 minutes later to confirm if the costs are going to be covered for an inspection as i did not want to fork out something that i cant recover, you had then mentioned that only reports from a Mercedes service center will be considered, i am not understanding why the whole concept of getting an independent report had changed?

Hi all I just thought I would give you an update on this. Mercedes were forced to take the car back under the sale of goods act 2015 due to it not being fit for purpose. The car was littered with problems. Mercedes Fought to the bitter end to keep me in that car and they lost. I first reported the car faulty to Mercedes Northampton in November 2017 and they finally admitted defeat on the 31st October 2018 so a whole year to get to that point. They was ordered to give me my deposit back of £15k and deduct usage charges for the car out of the monthly payments I had made. In regards to the deductions Mercedes finance thought that the £1700 a month I was paying for the car for the 12 months would be enough for the usage of the car even though they forced me to stay in the car for 12 months. This amount was also considered excessive so they are also in the process of refunding me some of this. They have refused to refund me for any of the independent reports that was done on the car at my cost, even though they knew the car had issues. The service I have had from the Mercedes Northampton has been next level shocking. The dealer principle Mark Hurley is the most unprofessional person I have met from a dealership. When I advised him I was having issues with the car his response was "this is why cars have warranties" how can you say that to a customer. He was basically telling me to piss off. Its clear to say I would never use this dealership again or buy another Mercedes, I feel sorry for any other up and coming GT owners. This dealer did nothing to help me and refused to answer any emails from the Ombudsman hence why it took so long. I contacted everyone within Sytner Group only to be passed back to Northampton and for then to get no response. At one point I had a guy on standby ready to sticker the car up telling everyone it was a faulty car and that there service was terrible. I told Mark Hurley I was in the process of doing this and he said if you step foot in this dealership he would call the police and have me removed, but this would not stop me or phase me. For how shit they have been I will wait for there next black tag event and do a nice speech in the dealership.

Mercedes finance asked if they could get there own inspection done on the car, I was reluctant to do this at first however agreed in the end, they used a company called ACE Vehicle Assessors based in Bradford who subbed it out to another guy called GILES LOVELL LIMITED. Before the assessor arrived I was a little bit sceptical that the report was going to be manipulated to favour Mercedes so unknown the the assessor I recorded the road test and the assessors talking to me, the assessor can be heard clearly saying that the car is not acceptable quality and justifies a rejection. Anyway the test was over and he said the report would be sent to Mercedes. The next day I received a copy of the report and low and behold the report said that there was nothing wrong with the car. I was fuming. It went the way I thought it would. I rang the assessor and asked what had gone on and he said that he didn't put that in his report so I contacted the company that asked him to do the report. I was shocked at what their response was. They advised me that the report reads what it reads and it wont be changed. I contacted the assessor again and I was then advised by the assessor that ACE had changed his report to make out there was nothing wrong with the car, he told me he was willing to go to court to back this up. I did not tell Mercedes or ACE at this point I had the examination recorded. I sent this onto the Ombudsman who advised Mercedes that due to the evidence I have on the recording there report will not stand up in court, I was happy to say the least and on this basis Mercedes need to collect the car and issue a full refund. If anyone wants to see the report then just let me know, they make interesting reading. Also as well just in case someone wants to buy a GTS beware of car registration number KX67UTN in yellow, Mercedes UK now have the car.

I advised that we could have an independent inspection carried out on your vehicle. This would be carried out by an independent engineer from either ACE or DEKRA, and not by a third party garage. We would take into consideration reports from either ACE or DEKRA as these are accredited and are trained specialists in their fields.

Sorry for the late reply but here is the link to the report. If there is one thing I can advice is DO NOT USE ACE, they will always favour the manufacture. Do some research on them and you will see every one will have the same opinion about them

sounds a bit like my car with the rattle.
I must say that is a lovely looking car though.

After this report was submitted did MB refund you imidiatley?

They had an AMG guy come over from Germany to inspect the car first who said it was fine and they told me to collect it and get on with driving it. I then had a Dekra report done at my cost, the Dekra report was then presented and they said they didn't believe what it was saying so they asked for another one so a second one was done at a cost again this report cost over 1k, they also said the second report was not good enough so they then wanted to carry out there own report at there cost which was carried out by ACE, and there report was shocking, it consists of a few pages. When ever you go down the rejection route the manufacture should be given a chance to have a report done on the car if they so wish. The only thing I can say is that you should be prepared for a fight, Mercedes will do everything they can to get out of having that car back, but if you feel the car is not right fight for it, there will be times when you feel like giving up be persistent. You can also request a copy of the report. Who are you dealing with at Mercedes??
 
I think what might focus attention would be for a collective of dissatisfied owners to take a stand at one of the major motor shows and exhibit a few vehicles with demonstrable faults and documentation of dealers and manufacturers failure to help .

Even better if it was right beside the marque stand .

Just book it as an owners club stand without letting on beforehand what is going to be displayed.

I don’t see why you have to bear such loss when they have accepted the rejection at the end, so they should f**king pay for it.

I haven't heard of her no. I have dealt with two managers over the course the first one was Sarah Bassett she was has good has a chocolate fire guard, she told me there was nothing wrong with the car the first time around and then kindly adviced me I had 7 days to return there courtesy car or legal action would be taken she then closed the case. When I challenged her she said she can only relay the information she has been given so there was nothing more she was willing to do, the second guy John he was ok however every proposal that was put forward he had to seek authorisation from MB UK before anything could be done so I didn't see why he was involved. I also dealt with Gary Savages secretary, he is the current CEO and she was sort of helpful at first but then ignored every email I sent to her. The CEO never replied once.

I did try and claim these back but they told me it wasnt something they was willing to consider. I cant tell
You how these people made me feel, they are beyond human. The support was near nothing, they gave me hurdle after hurdle to jump over but there was no way I was giving up. These people are blinded by there arrogance and they think that because they are so big they have the power to do what they want but I was willing to take it all the way to court if I needed too just because I was a stubborn **** about it. You can now understand why I will never own another Mercedes again. In all of this the dealer Mercedes Northampton was also has bad. They could not care less. I think it pissed them off more that this was the second GTS I had rejected because of poor quality. The first one broke down on day 1.
 
I’m trying so hard not to give up, feels like I’m dealing with a a bunch of potato’s. :-(

MarkPGTS, when did you actually take it to the ombudsman, was it after MBfinance did their investigation and declining a rejection with a final statement or was it before?

These B****rds are really pissing me off now, got the car back and now have a rattle on acceleration!
Feel like going down to MK head office and confronting them myself!

Hi sorry for the late reply I have only just logged back on. I notified the Ombudsman amout 3 months after having the car because Mercedes dis not want to help. In fact they did not give a shit. It took the Ombudsman the best part of a year to get it sorted. MB finance did there investigating and rejected all liability to do with the faults even though they knew they was there. Maybe. Although I suspect not because if they couldn't fix it for me as the first owner after having the car for months on end I doubt they would be fixed for any one else.
 
Did you ever have a private plate on it?

I suspected they would change the plate to hide the poor history from the next unlucky owner and it appears they have...

Not only that, it's become 6 months newer in the process.

No there was no private plate. It looks like it's still on the original plates. The KW17WMP was the first one that was rejected due to it breaking down on the first day. KX67UTN was the replacement and that was also rejected due to other major issues.
