So they are saying that the cracks have been caused by impact damage. If impact (whether it be pot hole, kerb or speed bump) then would there not be some other damage to the rim of the wheel as well. Does not look like there is to me.
I assume that you have the old wheels in your possession in case you need them for evidence?
I would reply to BMW very simply to state that you (and your wife) have only ever driven the car in a reasonable and careful way and have at no time encountered any major potholes or kerbs to cause the damage. You note that there is no other visible damage to the wheels to suggest that this could have happened. Therefore the wheels are not fit for the purpose intended and you are now formally requesting a full refund of £xxx. In the event that you do not refund the money within 14 days of the date of this letter then I will issue a summons for recovery from you. You can do this on line - I did it a few years ago when it was still a paper service - but if you google small claims I am sure it will bring it up. It was very simple to initiate the process and I am sure this will fire them into action. If it were me I would right off the £500 in my mind and treat this as a bit of sport to see what comes back; they dont deserve to rip you off like this. UNLESS of course you have been offroading in it
This needs to go as recorded delivery letter and it is much better to be a letter not an email if it comes to a court hearing. Keep a copy of course.
Last thing - an independent assessment of the wheels and what caused the cracks would be worth having done - especially one that is in writing from a recognisable specialist. If you had that the small claims court would be a done deal before you got there and BMW would know it.
