Bloody bmw

So they are saying that the cracks have been caused by impact damage. If impact (whether it be pot hole, kerb or speed bump) then would there not be some other damage to the rim of the wheel as well. Does not look like there is to me.
I assume that you have the old wheels in your possession in case you need them for evidence?
I would reply to BMW very simply to state that you (and your wife) have only ever driven the car in a reasonable and careful way and have at no time encountered any major potholes or kerbs to cause the damage. You note that there is no other visible damage to the wheels to suggest that this could have happened. Therefore the wheels are not fit for the purpose intended and you are now formally requesting a full refund of £xxx. In the event that you do not refund the money within 14 days of the date of this letter then I will issue a summons for recovery from you. You can do this on line - I did it a few years ago when it was still a paper service - but if you google small claims I am sure it will bring it up. It was very simple to initiate the process and I am sure this will fire them into action. If it were me I would right off the £500 in my mind and treat this as a bit of sport to see what comes back; they dont deserve to rip you off like this. UNLESS of course you have been offroading in it :)

This needs to go as recorded delivery letter and it is much better to be a letter not an email if it comes to a court hearing. Keep a copy of course.

Last thing - an independent assessment of the wheels and what caused the cracks would be worth having done - especially one that is in writing from a recognisable specialist. If you had that the small claims court would be a done deal before you got there and BMW would know it.

Good (Merc) today, bad (bmw) today.

BMW wheels then. Tuesday they did the run out test and 1 wheel 3mm out, the other 4mm out, should be max 0.3mm. Surprise surprise. Last 24hours involved their Regional Technical Manager, Aftersales Manager, Service Manager, Customer services - outcome - I'm still getting shafted in my opinion, for example, and I quote

"It is not possible for us to determine the cause of the cracks however under inflated tyres can make wheels more venerable to damage.
I do examine many wheels and the warranty guidelines are very clear as to how a manufacturing defect can be identified. My opinion is that the damage is caused by an external influence and not a defect.
It may be a benefit to gain the opinion of another BMW dealer on the warranty status of the wheels."

So given the choice of risking my family with a wheel collapse I'll be shelling out and then going for BMW via the small claims route. Scothalls at least promised to do them for cost -now just waiting to see if they are happy to use the tryes as they still have a good 6mm on them.

As for Merc and my C230k, the Service Manager finallly clarified I can expect by bill to be £525 for the B service, Spark Plugs, Fuel & Air Filter. Apparanly the atf fluid doesnt need doing ever...

the last half hour I've been on Autotrader looking at CLS320CDI's for £21-22k, could be the 330d replacement

How frustrating for you. I wish you the best of luck. Trading standards are usually very helpful and well worth a call if thats what you need. Small claims is also a good route, and trading standards can support you with this. I am sick and tired of high powered organisations ganging up against the common enemy " the customer ". Insurance companies, dealerships, all the high street organisations tacky carpet, and sofa stores, massive car dealerships that charge 100% apr to the most vulnerable of society etc etc..we all know who they are. You just have to be one step ahead of them..be prepared, but be nice, and always expect a battle. There is no trust anymore, even the most trustworthy of punters are seen as the the common enemy....

You know since purchasing my father in laws 1994 Cavalier I have been on cloud nine. ...it drives better than my bmw, I get 37 mph ( 2 litre ) ..I get parts from the scrap yard for pocket money,, I have no monthly repayments, it costs me 140 pounds fully comp to insure, I can leave it anywhere, If I kerb the alloys or get the odd dent I am not going to be given a huge bill when I give the car back ( if its one of those lease jobs )...and the best thing is that I am old enough to dont give a flying pig what people think.I dont have to prove anything anymore..it is so empowering.
