My E63 has been in the dealer workshop for 5 months...

No, not in an E63 I haven't. Course, neither has anybody else for five months! :D

Yep definitely ask for 100% back and tell dealer that in view of your longstanding relationship you will forgo a claim for inconvenience . I really wouldn't get a solicitor involved at this stage- easy to run up a huge bill for no reason, but obviously up to you. If the dealer resists (and I cant see what grounds they could possibly have) speak to Trading Standards- they really don't like car dealers anyway but they can give you details of the precise wording of the legislation which applies. I wonder how long a really good indie would have taken to diagnose, get the right parts, and fix the issue- not 5 months that's for sure- obviously that wasn't an option for you though.
 
Yes this seems to be the way in which i think it will go now. If Mercedes give me the original sale value back is another question...:confused:

The way it usually works is that they will deduct from the original price paid a certain amount based on how much use you had of the car - e.g. if you have done say 10,000 miles in the car since new etc. So they most probably won't refund the original buying price, but they will come to a fair arrangement with you.
 
Morning all, quick update... arranged to see my solicitor tomorrow, so we shall see what happens regarding that :dk:

Anyway, was cleaning my E350 yesterday. In my perfect world, id have the exterior of the W212 with the interior of the new one! :D
 
Off topic, but you have my favourite tree!

The ones that look like they're made from green pipe cleaners. Always liked them. There's one about a mile from me and it's almost a landmark.

Do you know their name?

aha, if i recall correctly its either a Araucaria araucana or Sitka Spurce. I have too many different trees in my garden lol
 
If it helps, when my S205 was playing up over 8 months with no fix in sight the car was rejected and accepted.

Whilst on finance the MB dealer settled this in full and returned my deposit also in full :-)

A little bit of pleasing the customer and the dealer discounted a new GLC to match the list of the previous S205 deal.

I didn't need a solicitor to sort it, I wrote to MB finance pointed out the reasons for rejection and sent a copy to the dealer whilst informing them of my actions.

Took 2 weeks to agree the rejection and another 2 weeks to sort out a deal.

This is one of those occasions where having finance on a vehicle becomes an advantage. Your rights to reject and levels of protection are somewhat more due to finance regulations than if you'd bought outright. You also bought new.

I have a feeling the OP bought in full, used. Which moves the goal posts somewhat. However, it's in warranty (or was when dismantled by the dealer) so the onus is on the manufacturer to solve the problem.

Thanks for that, I've chosen not to go down the solicitor route now. But your experience definitely gives me some hope!! :thumb:
 
Morning all, quick update for those interested...

I haven't gone down the solicitor route, as I've been advised that at this stage its unnecessary and similar cases have been solved without one.

But, as my luck goes... i had a phone call yesterday saying my car is ready. Yet a few days ago it was a jigsaw on the workshop floor? I have refused to take my car till this is sorted though.

So i have now sent a letter to Mercedes Milton Keynes explaining my situation and also stating various clauses which they've breached in their sales contract and the sales of good act. And also saying i require a full refund or legal proceedings will be taken.

Hopefully this will do the trick!! As I've seen the car i want to replace it with! :D;)
 
Hope you get it sorted- Personally I think you are doing right in rejecting the car. The other thing to consider is what state the car will be in after 5 months in the workshop - dealers are not exactly renowned for treating vehicles with respect! Fingers crossed.
 
I wonder what kind of defence the dealer/MB will put up?

My guess is that they will argue that the car is now repaired therefore not eligible for rejection. Or, maybe, time barred?

Well i emailed my letter to the Milton Keynes head office, the aftersales and general managers at the dealership that the car has been repaired/ruined at. Milton Keynes called me within the hour of sending the letter for more information regarding the dispute. And the aftersales manager replied to my email asking if it concerned him or if it was just for his information??:mad: so i think the local dealer will be the issue if there is one...

Thank you, and very true. I hate to think what kind of state the car has been in over the past few months. I feel as if the car will never be the same if i took it back:(
