I agree DM there's far to much scratchiness these days.
I asked Mr 6 years at law school a very simple question after he posted his opinion on the OP's position. My feeling is that the OP needs a lot more information before he knows what his option are. Nobody yet knows what the cause of the fire was, we have to wait for more information.
So when EJUK announces from the Mount: "Legally MB have the right to either repair and fix or replace outright. You could argue you have lost faith in said car and want full refund. Latter option would probably go through civil courts."
I thought it was reasonable to ask:"What do you base these statements on?" A perfectly simple and straight forward question. I wondered how he was in a position to make such an emphatic declaration and thought that perhaps he knew something we did not. But no, it was based on: "6 years at law school". One of the snippiest replies I've seen for a while and perhaps magnified because it was the third post made by EJUK.
In the usual course of events I would have left it at that. However, next thing we get is: "Thought people were here to help on the forum." Extraordinary!
Well Mr EJUK, people on this forum do help a lot, but they are also (usually) reasonable polite. IMHO you have failed the attitude test.
