The comment on the spin is a valid one, if you are not happy for poor young chaps to be dealt with for swearing in public on the one hand, but want a harder line on the other, there is always going to be someone unhappy whatever the action/inaction.

Not reporting the crime is falling for the spin.....

Are we sure that this is not just another revenue earner. I guess we all remember the story about Westminster Council giving away a brand new Ford Focus (i think?) at christmas time to the traffic warden who had issued the most tickets. Perhaps when the WPC has issued say 200 £80 fines she gets to have her own police car as she has duly paid for it ??.
 
section 5 of the public order act states that the 'Threatening, abusive or Insulting behaviour or language' need only be within the hearing or sight of a person LIKELY to be caused harassment alarm or distress. There is no requirement that the conduct is directed at any specific person (section 4 covers this). Further, there need not be a person present. This is intended to cover the old age pensioner scenario already mentioned. Imagine sitting in your own home listening to foul language across the road...not nice!
If the foul language is directed personally at someone then the offence is more serious and a fixed penalty notice cannot be issued.

tell you a depressing story tho. i was out on a job with a colleague on friday. he was telling me his son worked at sainsburys. i told him i have sacked sainsburys due to them employing incompetant staff and now use tescos. i explaind to him that i was purchasing 8 bottles of Old Speckled Hen. the cashire got a bout of till rage and decided to charge me £79.99 for 8 bottles. i didnt even smile, i just assertivly suggested that it was wrong and for her to contact her supervisor. we got it sorted for the £9.99 it was meant to be.

this collegue of mine said he couldn't stand old specked hen. he said the best beer was................................................

i muttered something about it being lager and buried my head in the paperwork shakin with depression.

i might aswell add my tupence, few years back myself,dad, mum and younger sister were coming back home to streatham, at that time i was driving my dad's granada scorpio and those who know the road the high rd has 3 lanes. as i was minding my own business driving in the left lane a mondeo estate suddenly overtakes and cuts me up, dad told me to steer clear of this guy as he was driving like a lunatic so i switched lanes to avoid him into the far right. this guy was zig zagging left and right out of cars at speed and then again cut me up in the right lane but this time round he almost hit me so i had to brake hard and swerve away to miss him. anyway he didnt get far and i caught up with him at the lights with me being on the right lane and him in middle lane so i honked the horn to get his attention and said to him '' careful mate ,you almost crashed into me'', his response was '' you wanna fight''. at this point i put the windows up and was waiting for the light to turn green when this bloke got out the car, he was about 6ft 2 and was wearing a millwall t-shirt and came round to my side hurling abuse and telling me to get out of the car as he was trying to open my door. next thing i know is this guy started to punch and kick the door of my car as i wouldnt get out and at the back his girlfriend had smashed the window of the car and was trying to drag my little sister out of the car with my mum trying to pull her in. by this time the whole traffic had stopped but no one came to our rescue and i could hear people say incl. the bus driver ''f***ING MOVE OUT THE WAY AND STOP BLOCKING THE F***ING TRAFFIC''. luckily my mum had managed to pull my sister into the car at which point i put my foot down and drove away as fast as possible. a mile up the road i stopped the car and called the police giving every single detail about the incident, luckily my family was alright, just shooked and shaken. half an hour later the police turned up at my doorstep and told me they could not find the car or the driver but as soon as they do they will let me know, i then showed them my dads car which now had dents in the drivers door and rear passenger door and a smashed window. one of the coppers asked me do i have fully comp insurance to which i replied yes. he casually said to me claim through your insurance, whilst the other copper said to me theres no need, just t-cut the car and it will be fine. they left after that and i never heard from them again.

I must commend your father for showing a great deal of common sense.

With the greatest of respect you have not won any prizes. Blaming the Police is understandable, but I dread to think how this crazy lunatic would have 'thanked you' for reporting him, and I bet his story would have been very similar to yours but you would have been the lunatic. I am certainly not saying you were driving stupidly, but have you read the thread about the poor innocent young gentleman that very quietly swore at his friend and actually got harrassed by a Police Woman with very sensitive hearing?? Other people are not always the honest folks we like to think they should be.

There was an extremely simple, easy way of avoiding this, but it highlights the consequences of this so called red mist. Other members no doubt will disagree with my observations, puff out their chests and write stories of how macho they would have been. :D

YOU endangered your little sister and sadly I feel YOU also endangered your mother and father? I say this with the utmost of respect to you and clearly your very nice family. If you had simply let this lunatic go, it would have been a very safe, but boring journey. Why on earth chase after this imbecile and then blast (honk) your horn at them?

whilst I agree with you entirely, fnkhan says he just came alongside the other driver at the lights. There was no chase.
 
dieselman is correct, i gave no chase, likewise i didnt think that just by honking the horn would have consequences like this as i was not abusive or insulting towards this guy. as soon as he stepped out the car my dad said to lock the doors and close the windows which i did. i did everything to avoid this car but i eventually caught it up at the lights and the two reasons i didnt act macho was my family's safety comes first and secondlyafter he got out the car and i saw the size of him i knew he would knock my lights out as i am a mere 5ft 8. also my car was damaged, not his unless he decided to smash it up himself. the moral really of this story was '' KEEP A COOL HEAD AS ITS NEVER WORTH IT'' ,there are serious nutters out there. as for the police i thought they are there to give reasurance to public, definately didnt give me any.

I have read your reply and also the victims and I do seriously feel for him and he clearly states he was in the left hand lane minding his own business doing no harm to no one when this lunatic carves him up and then.....

When the innocent victim actually catches up with this lunatic? the victim is now in the offside lane and the idiot is in the middle lane? Now we all agree that the idiot clearly has a problem, so we blast\honk\politely beep and say, "careful mate ,you almost crashed into me''.

Now as a complete outsider I tend to look at the faster car making the better progress and it will usually hog the outside lane and undertake to gain advantage.

The family driver that tends to stick to the nearside lane or drive in a steady calm manner will simply not keep up with Toad of Toad Hall. In my experience the Police will usually prefer to have an independant witness to any type of road rage as I am still 100% convinced that the other party will simply say how our victim hurled abuse at him, pursued him, and he tried to get away from the individual. I accept how your car was damaged but we always tend to only hear one side of any story and I am being the proverbial pain in the butt and very politely playing Devils advocate.

I certainly do not mean to be offensive and I politely say to you and everyone else that gets tempted to pursue\follow\keep up with these idiots..... Don't, don't get involved, don't follow them, and most important do not even make eye contact with tem. There is a member on this forum who grew up never knowing his father!!!! How would we want our children to grow up not knowing theirs.

If you really want me to agree with your conduct then fine, but I would not be acting responsibly. :o
