Yes he has broken the law.
Yes the punishment is points and a fine.
Does he deserve that? Absolutely not.
Does the punishment fit the crime? No way.
If there was no financial gain in speeding cases, will it be pursued so vigorously? No way
Does collecting money make people slow down? I do not know.
Are car drivers that break speeding laws, treated like other members of society that commit crime? NO way.

I mean where is the first warning?, then the second and third and fourth?
Where is the bound over to keep peace? where is the police caution? where is the (this is fraud) not our case sir

I guess he has committed crime than this guy.

Tragic story, he won't make that mistake again, but its an accident, no intent to harm or injure so I wouldn't want to see him in jail, but a ban would be nice. There is negligence on his part, and dare I say civil proceedings will be lodged against him.

an accident yes that was caused by wearing the wrong glasses so he was probably the cause of it .
imaging causing an accident by speeding? The points will be the least of your problems

Yes, or if you had a beer too many the night before and you were unintentionally over the limit. You'd be picking the soap up in prison. Speeding to a very small degree is a crime of intent arguably as you're willingly doing it, heightening the risk to others, but IMHO speeding is a very petty crime and just because it ends tragically doesn't mean you meant to injure or kill someone, so you shouldn't go to prison etc. People who take drugs, burgal, rape, kill, assualt should.

I know someone who did 3 years for killing a woman by running them over, but he was plastered @ the time. She was changing her wheel @ the side of the road, ran into her taking her head clean off. He was well over the limit. He is out of prison now, but hasn't learnt the errors of his ways  and still drink drives. He must have liked Barlinie, all that Sky TV they get these days

Invest in sat nav with safety camera feature to remind you of your speed limits. Dong Dong.

And/or now stop me if you've heard this one: FOLLOW THE RULES OF THE ROAD
That little clock on your dash is supposed to remind you of what speed you are doing IIRC.

How long does it take to have the 3 points removed? is it three years?
The points count for 3 years from the date of the offence for speeding but remain on the licence for 4 years before they can be removed.

...... you have allowance of +10%.
10%+2mph - ACPO guidelines only and not statute.

Could you not have made a silly excuse, or just deny it. Unless they were gathering evidence, (video footage, timed tailings with a calibrated speedo etc) I'd be tempted to challenge it. Did you admit to the offence, never do that as thats the evidence for the crime.
Someone's been trawling those dodgy 'speeding advice' websites on the net - remember they're there to make money and their advice is sometimes incorrect :D

Didn't I read it somewhere you have to commit the offence for at least a quarter of a mile before they can charged you?
Janet and John go to court (penguin books circa 1972). Chapter 2 para 4 ;)

How true. I would say 90% of road-users I stop and report for speeding take it on the chin and put their hands up to this NON-CRIMINAL offence. I've heard all the excuses mentioned on this and many other threads but ultimately we (as motorists) are in control (or should be) of the accelerator, brakes, steering et-al. We know that if we break the speed limit unlawfully we run the risk of being prosecuted. Stay to the speed limits and the boys in blue (with white caps and no hearts) will leave you be.

Typical of you to come out with something radical and inflamatory..
Surely you can't expect some of our younger members to accept that..

:D

not strictly true:D
I stay to the speed limits, but have been stopped for attempting to speed,
making a u-turn in a close and wheel spinning out of a junction ( caused by dust on the road).

all resulting in watch your speed mate, drive carefully - which was irrelevant as i was not speeding in the first place

Stay to the speed limits and don't drive like a **** and the boys in blue (with white caps and no hearts) will leave you be.

I think he meant to say.. ^

still irrelevant as i was not driving like a **** as if i was it would certainly have been £60 and 3 points mate.
Not a watch your speed malachy

I got stopped by some fool driving a dog van once.

Plod dogman was doing 35 in a 60 zone, so I overtook, as I did so the blue light came on...

He told me that I'd over taken in front of a farm track, I asked what possible relevance that had on anything. He said what if a young girl and her kiddie had walked out into the road, I felt like saying that there would be bits of young girl, kidde and pram all over the place, but thought better of it.

After 5 minutes of dressing me down, and me appologising for invisible crimes, I was let on my way....

Drive along A13, see how many stick to the 40mph speed limit? Only dudes do that about 10%.

As unmarked pointed out you should be able to get away if you did 35 in 30mph zone. 30+3+2 = 35. If you readily admit it, too bad.

like if the kid had been hit by him with his dogvan it would not be a similar result.

Erm, surely if your wheels spun then you accelerated too fast possibly for the conditions

Yes that maybe true but you gave the impression that you were speeding with your antics perhaps

do not know where you get your laws from. speed is an absolute offence.
30mph is 30mph. 31 mph is an offence and these are just guidelines that vary from mood of plod, force and whoever stops you/ period ending

I had someone pull out on me a good few years back, as I ploughed into their car and rolled to a halt the world lit up blue. Turned out there was a police car 4 cars behind me, woman pc says to me see what happens when you run a red light, I point out that light was green, she says we were not looking at the time anyway....

Perhaps I'm just unlucky in that all police officers I've ever had to deal with have all been liars?

i had a FWD car. which does 0-60 about 15secs. i came out of a t-junction on a dusty road, wheel spun and i was stopped in less than 5 secs by plodd. speed limit 60. i had not even reached 20mph. wheel spinning is not an offence, and giving an impression is just no case for making a stop.
Driving a car is giving the impression you might have an accident soon and what antics was i doing that gave an impression? surely an impression is matter of opinion and not fact

you do realise that when dust is in front of a FWD car it can cause you to spin your wheels at any take off speed.

to be honest mate, this is not a driving offence or should not even warrant a stop. Too fast for the conditions, means on a rainy wet day anyone doing 70mph on the motorway will get stopped.I broke no laws and i drove like i normally would. unfortunately the road at that time was very dusty. it may have been black ice and i may have skidded into the road who knows?

£60 quite painful. You should have said I needed the toilet for you got diarrhoea and needed to get home quick. :D

that did the trick for Alex Ferguson. i believe he was let off in court

appearantly Piers Morgan then wrote him a note saying the he always thought Alex F. was full of s**t :D
