Advice needed, Got 3 points and a £60 fine

OK Spike is bang on here there is something else we don't know.

There is no such offence as having too hard suspension, the Subaru rally car in my sig is road legal and you wont ever get harder suspension than that. Coilovers are fine will pass an MOT and are perfectly road legal. You need to post the exact offence stated on the FPN then we can help more.

If they were that concerned they should have impounded the car, if they suspected a suspension fault they should have given him a VRN (Vehicle Rectification Notice) to remedy the problem.

If the gave him a fixed penalty and sent him on his way then quite frankly they are taking the P*ss and I would see them in court to sort it.

However I suspect there is something more to this that your brother is not telling you.

With the true facts we are a knowledgeable bunch and can help

He must have been stopped before? If the car has a Valid MOT, Insurance, Tax then how can they fine him for something wrong with his car yet let him drive it home???

Its either road legal or not? Not 'OK' to be on the road.

I have freinds with Track cars, and one with a Lotus exige, It has incredibly hard suspension, I'm 18 stone and pushing down the car hardly moves !!!

Sorry I have to say there is more to it than this. Was it a 'proper' patrol car or panda?

Is it the fact your brother is 21 and drives a VR6?

Do you have a picture of the car in its current 'low'ness

For a start, I'm sure the car is low but the VR has a very low sump so it won't be insanely low. My sump plug is 3 sided :D

Recently I've heard of a guy who was so fed of people taking the mick out of his escort saloon ("It's an Orion!") that he put Orion badges on the back - he got 3 points. Another fellow took the VW badges off his Golf, a common smoothing thing, and got 3 points for his trouble too.

The police are becoming more and more hostile to anything that isn't as it left the factory; "first they came for the Saxo drivers, and I kept quiet because I didn't drive a Saxo.." :thumb:

Will be interesting to see what the offence code is though.

My brother has never been in any kind of trouble before.

The car is fully MOT/TAX/INSURANCE ETC.

My Brother was traveling around a roundabout in slow moving traffic and was asked by a passing police vehice to pull over. THATS IT.

The only odd thing here is he shouldn't have got done for anything.
He has a clean licence and never been in any trouble.

There is nothing more to add to this.

I'm taking legal advice on this one. I have been advised to get a new MOT and get a independant engineers report.
The police are no engineers and no did they have a ramp on the road to make a tests or checks.

I will make sure my brother goes to court to see the end of this. He has my full support on this.

Both were done for the same offence - in effect, 'disguising the vehicle' - as per Mr Policeman, "ere ere, what if you 'it a kid or another car and drove off eh?"

If you annoy the wrong policeman, possibly, yes.
 
if its the full story, then i would dispute the ticket ! take it to court (make sure the car is FULLY legal tho).

it may have bounced a bit too much for the coppers ! i have friends with VW`s which have coil-overs and touch the ground almost and still fly through MOT`s as there is nothing illegal about lowered\stiff suspension.
 
There's no smoke without fire, so there must have been something to attract the coppers' attention. With cars obvioulsy modded in any way, you may as well wave a flag for coppers to pull you. Tinted windows, loud hi fi, drain pipe exhaust, 'personalised' plates etc. The best thing is to blend in with everyone else, keep your head down and your nose clean.

It will be interesting to see what happens in this case.

A friend who is a Doctor in Scotland was driving his two boys to Cubs in a non-descript people carrier (blends in nicely) executed a perfectly lawful overtaking manoeuvre and was pulled over by the cops and told if he did that again, he could be issued with an ASBO and his car impounded. Obviously it is only in Scotland where ASBOs have been extended to cover motorists doing things that may alarm or distress other road users, but plod were perfectly happy singling out an ordinary, blended in member of the public, who it must be said was furious but got nowhere as an ASBO is a civil matter.

Abuse of power isn't uncommon.

Actually , traffic police are quite highly qualified as the TPO course does involve a number of modules in motor engineering .

If it was , on the other hand , just a general beat cop in his panda car , he would have no specialist knowledge .

I , too , will be interested to hear the full details of this case as there is no law specifying the 'stiffness' of a vehicle's suspension and , on the face of it , this sounds as if there is no case to answer .

Sorry, tis true. I think a lot of people here have rose-tinted specs when it comes to what a bunch of fascists the police can be, especially towards anyone they take a dislike to.

I think the Doctor has misheard or misunderstood the officer. Under the Anti-Social Behaviour (Scotland) Act 2004. sec.126 & 127.
A vehicle can be siezed if it is driven in a way as to cause alarm or distress to other road users or the members of the public but, only after a warning has already been given and recorded on the P.N.C..
As an ASB investigator for the council I can confirm that you cannot get an ASBO for Driving Offences.
Though sometimes the polis find it easier to use the A.S.B.Act rather than the R.T.Act. for some motoring offences
