Hit by a cyclist.

Hi

I had a cyclist ride straight across the road today and run straight into the side of me.

He has damaged the drivers wing and front bumper.

He did admit that he was at fault and appologised but fled the scene before the Police arrived and I have no details for him at all.

Under my insurance am I liable or this classed as some form of hit and run??

Ive always wondered this, how could you get them to pay up etc, let us know how you get on.
 
Errr, believe this or not but sometime last year I believe the law was changed thus....

'With a collision involving a cyclist and a vehicle the vehicle driver is automatically assumed to be in the wrong no matter who hit who and how. He or she (the driver) is expected to provide the cyclist with their insurance details and report the accident/incident to the Police to enable the cyclist to persue damages and the Police to consider prosecution'.

So a cyclist whacks you and its your fault, mmnnn, now where did I put my wallet? CAAARAZY :mad:. I dont agree but thats the world we live in!

Last time I hit one (gulp!) it was his fault, he apologised and admitted responsibility then took off. I had to pay the excess for a claim. :-(
 
i reckon if you could identify and proove it was his fault with witnesses and better still CCTV you could reclaim in the small claims court.
 
Looks i will be paying the excess then. Even if i could get hold any witnesses or CCTV footage its very unlikey they would be able to trace the guy.
 
Would the Motor Insurance Bureau....or whatever its called cover this kind of case??
