If you do not know the answer then say so like rory did instead of posting about filling stations.

I think techically the registered keeper is ultimately responsible.

However if they could reasonably prove it wasn't them, and the Crown couldn't prove otherwise, then I can't see how a prossecution could be successful.

That was a bit different in that they claimed they couldn't be sure who was driving when the car was snapped - whereas your scenario has the RK certain is was someone else, the the other person certain it wasn't them.

The Hamiton situation has become popularly known as the Hamilton Defence, but in another court the Mags could easily have decided that the RK (I think it was Mrs H) should have known and fined him. Or they could have listened to both stories and randomly decided to fine one or the other. Both would be wrong (in my opinion), but would it worth risking an appeal?

Got my letter yesterday.

A choice of £60 and 3 points or attend a naughty boy's driving school :o
It's £87.50 and lasts 6 hours. I'd have to take a day off so I may opt for the £60 fine and 3 points. I have no other points on my licence. Will 3 points affect any future insurance premiums ?

I've no idea what they do at driving school, but there's a possibility that you could actually get something from it - especially if you get some one-to-one tuition. I certainly learn something new each time I had safer driving tuition. Worth considering.
 
Personally I'd take the get out of jail free option.

You never know when you might collect some more points and you won't get the same offer again.

I guess to know for sure you'd need to ask your insurance company - but they that would be telling them anyway. Wonder if, strictly speaking, you ought to inform them whatever you decide to do?

I'm insured with Frizzell (Liverpool Victoria) and they don't even require to be told.

I would certainly be inclined to keep a clean licence clean. I'm sure the course will be unspeakably annoying, especially if there's no actual driving.

If you are still 'convicted' of a motoring offence (by taking the course you are effectively paying a fine) then yes - depends on the wording of the letter I guess. If not convicted of anything I'm sure you don't have to disclose (any more than you would a Police warning or caution).

I realise that you've put convicted in speech marks, but it's an important legal distinction that you can only be convicted by a court - even the fixed penalty is exactly that, a penalty, not a fine.

I have read good reports on this forum about these courses, but I only know one person that has actually attended one. He was made to feel like a naughty schoolboy, they sat in a classroom and were spoken down to by a traffic officer that criticised their selfish driving even though this officer had never witnessed their driving abilities. My friend got absolutely nothing out of the course and instead now thinks traffic police are obnoxious, arrogant, self opinionated bullies. :rolleyes: I could have saved him a whole heap of time and told him that before he went. :devil:

I hope your experience is much better than my friends and you get some benefit from the course.

A friend took the course option and was very glad she did, learnt some invaluable lessons and would recommend it to everyone in this situation. Got done twice with a week of buying her new TT!! Oops...

Well they had broken the law, and could have taken the points instead.

A collegue went on one and thought it was Ok and did learn something. If ever there are multiple speed camera warning signs, the one just prior to the camera will have a small speed limit sign on it..;)

Seems pretty reasonable to tell them that don't you think?

Another collegue was stopped for speeding in her BMW Cabriolet and said to the Policeman.."You cant give me any points", to which he said "I'll be the judge of that"

She then explained that she already had nine points so couln't be given a standard ticket...to which he said...
"Thought so. You're the woman who had a Celica I gave points to before.."

She had an education day instaed of a ban. Probably a good deal then..

I would say yes, it did with me but I was not given the choice of the naughty boys driving school. The addition in premiums will not be more than the £87.50 over three years it is on your license though. As the advert says, you are an accident waiting to happen in the eyes of an insurance risk assessor now:D :D

There are *many* people who *really* need to go on these courses, though!

My Dad, for example, had (he's just stopped driving now) no concept of speed limits whatsoever. All his driving is around town, and his speed was limited only by that of the cars in front of him.

If I take my Mother anywhere, she'll tut at how slowly I'm going (this will be at 40ish on 40MPH dual carrigeway). She commented once after a trip that she'd seen things that she'd never seen before, as usually my Dad just whizzed past them.
